This bill implements Article 12a of the Charter for the Kingdom of the Netherlands (hereinafter: the Charter), which provides that provisions are made by Kingdom Act for the handling of disputes between the Kingdom and the countries designated by Kingdom Act.

The bill states that the existence of a dispute will be established during a continued consultation as referred to in Article 12, paragraph 2, of the Charter. If the objections relate to the interpretation of the provisions of or pursuant to the Charter and these objections have not been resolved during a continued consultation, a Minister Plenipotentiary can declare that this objection has continued to exist (dispute) and request a judgment from the Kingdom Disputes Division of the Council of State of the Kingdom. The chairman of the Council of Ministers of the Kingdom may decide to reject this request if an overriding interest of the Kingdom requires immediate decision-making (Article 1, second paragraph, first sentence).

A dispute can relate to any intended decision of the Kingdom Council of Ministers, except decisions or intended decisions for which a special procedure has already been provided for by Kingdom Act or Order in Council (1), proposals for Kingdom Acts or draft general measures in Council of State (2) , or decisions or intended decisions that can be submitted to the Council of State of the Kingdom or to the Kingdom Disputes Division thereof on the basis of a special arrangement (3).

In response to a request, the Kingdom Disputes Division of the Council of State of the Kingdom establishes a judgment and informs the Minister of the Interior and Kingdom Relations, who then informs the parties of that judgment. The Council of Ministers of the Kingdom will follow the Division’s judgment unless the nature and weight of the objection established do not outweigh an overriding interest, or unless relevant facts and circumstances that have arisen after the request for an opinion make it necessary to a decision that deviates from the judgment.

The final decision, as well as the opinion of the Advisory Division of the Council of State of the Kingdom, will be announced simultaneously in the Government Gazette, unless this cannot be omitted pursuant to Article 26(4) of the Council of State Act. In the event that the opinion is deviated from, there is an obligation to disclose the reasons for the deviation from the opinion.

Finally, the bill provides for an evaluation of the effectiveness and effects of the Kingdom Act in practice within three years after entry into force.

The State Secretary for the Interior and Kingdom Relations (BZK) has withdrawn the bill by letter dated September 24, 2021 ( EK, Q with annex ) .

On 21 June 2022, the Senate Committee on Kingdom Relations (KOREL) decided to offer the opportunity on 12 July 2022 to provide input for further written consultations following the report of a further written consultation with the State Secretary of the Interior and Kingdom Relations on 9 June 2022 regarding possibilities to challenge (intended) decisions of the Kingdom government ( EK, S ).
