THE HAGUE The Netherlands is phasing out personnel support to the hospitals of Curaçao and Sint Maarten. This is reported by the Dutch Minister of Health Ernst Kuipers in a letter about the state of affairs to the House of Representatives.

The American medical employment agency AMI stepped in in December when the omikron variant emerged. The Netherlands pays for the extra support to the hospitals. Kuipers writes that the number of active infections on the islands is decreasing. Especially in Sint Maarten, help was urgently needed because many healthcare staff got corona themselves. DEN HAAG Nederland bouwt de personele steun aan de ziekenhuizen van Curaçao en Sint Maarten af. Dat meldt de Nederlandse minister van Volksgezondheid Ernst Kuipers in een brief over de stand van zaken aan de Tweede Kamer.

Het Amerikaanse medische uitzendbureau AMI sprong in december bij toen de omikron-variant opkwam. Nederland betaalt voor de extra ondersteuning aan de ziekenhuizen. Kuipers schrijft dat het aantal actieve besmettingen op de eilanden daalt. Vooral in Sint Maarten was de hulp dringend nodig omdat veel zorgpersoneel zelf corona kreeg. Nederland betaalt op Curaçao en Aruba ook de boostercampagnes en de zogenaamde fijnmazige campagnes. Dus niet boosteren in grote priklocaties, maar juist in buurthuizen, kerken en andere vertrouwde plekken in de wijken waar de vaccinatiegraad nog laag is.

This Wednesday, February 16, 2022, a day of tribute to the dead and the heroes of the National Gendarmerie, a ceremony chaired by the Secretary General, Sub-Prefect Fabien SESE took place at the Savane barracks under the command of Lieutenant Colonel Maxime Wintzer-Wehekind. The civil and military authorities paid tribute to three gendarmes who died while carrying out their mission this year and hailed the “ordinary heroes who act in the discretion and humility of daily service”, in the words of Interior Minister Gérald Darmanin, delivered to the reading of the Secretary General.

Three gendarmes have died in France in the exercise of their functions since January 1, 2021: the maréchale des logis-chef Jennifer Benet, of the command group of the departmental gendarmerie company of Hyères, on September 28, 2021 at the age 36 years old, Constable Gaëtan Binet, from the Port-Jérôme-sur-Seine local brigade, on October 7, 2021 at the age of 27, and Chief Marshal Claude Ruocco, from the surveillance platoon and intervention of the Dardilly gendarmerie, on January 15, 2022 at the age of 53.
On this occasion, three Gendarmes from the Compagnie de Saint-Martin were honored for their commitment and action in the service of the population.

Ce mercredi 16 février 2022, journée d’hommage aux morts et aux héros de la Gendarmerie Nationale, une cérémonie présidée par Monsieur le Secrétaire Général, Sous-Préfet Fabien SESE s’est déroulée à la caserne de la Savane sous le commandement du Lieutenant Colonel Maxime Wintzer-Wehekind. Les autorités civiles et militaires ont rendu hommage à trois gendarmes morts en accomplissant leur mission cette année et salué les «héros ordinaires qui agissent dans la discrétion et l’humilité du service quotidien», selon les mots du ministre de l’Intérieur Gérald Darmanin, prononcés à la lecture de Monsieur le Secrétaire Général.

St Maarten Curacao Aruba 1 BILLION Received Liquidity Support

As of April 2020, the autonomous countries of Aruba, Curaçao and Sint Maarten (hereinafter: the countries) have received more than € 1 billion in liquidity support to absorb the financial and economic effects of the Covid-19 pandemic. This was done after a decision to that effect was made in the Kingdom Council of Ministers, partly on the basis of the advice of the Board of (Aruba) Financial Supervision (C(A)ft) and reports from the Temporary Work Organization of the Ministry of the Interior and Kingdom Relations (TWO).
The provision of liquidity support was preceded by permission from the Rijksminsterraad (RMR) to the countries to be allowed to deviate from the central budget standards for the budget years 2020 and 2021. For Curaçao and Sint Maarten, this concerned the budget standards from Article 15 of the Curaçao Financial Supervision Act. and Sint Maarten (Rft). In these years Aruba was allowed to deviate from the standards as included in Article 14 of the National Ordinance Aruba Financial Supervision (LAft) and the Protocol Aruba and the Netherlands 2019-2021.

In the RMR of 4 February, a decision was made about the requests from the countries to be allowed to deviate from the budgetary norms for the 2022 budget year as well. In addition, a decision was made about Aruba’s request to be allowed to phase out the salary discount for employees in the (semi-) public sector and for ministers and members of parliament from 2022. This salary discount was part of the decision in the RMR of 15 May 2020 about the second tranche of liquidity support. With this letter I inform your House about the decision-making of February 4, as well as about the extension of the protocol Aruba and the Netherlands 2019-2021.

Aruba-Netherlands protocol extension 2019-2021
On January 20, 2022, the governments of Aruba and the Netherlands agreed that the duration of Protocol Aruba Netherlands 2019-2021 “Framing the path towards solid, transparent and sustainable public finances of Aruba” (hereinafter: the protocol) will be extended by two years to 31 December 2023. It has also been agreed that the protocol will expire if the Kingdom Act Aruba Financial Supervision (RAft), the proposal of which will soon be shared with your House, enters into force earlier than December 31, 2023. With this extension, the budget standards have been established against which the Kingdom Council of Ministers can assess the budget of Aruba for 2022 and 2023.

Application of Article 25 of the Rft and Article 23 of the LAft and degree of deviation
Due to the continuing effects of the corona crisis on the budgets of the countries, the Kingdom Council of Ministers has, in accordance with the advice of the C(A)ft, agreed to a deviation from the budget standard as contained in Article 15 of the Rft for Curaçao and Sint Maarten and from the standard for the applicable financing balance as contained in article 14 of the LAft and the protocol for Aruba. The permitted degree of deviation from the norm is, as in previous years, for the fiscal year 2022 equated to the total of loans that the country takes out for expenditure during 2022, corrected for the change in the country’s liquidity balance at the end of the year. The loans mentioned above require prior approval from the RMR.

Reduction of the salary discount
When deciding on the second tranche of liquidity support on 15 May 2020, the RMR decided on a discount on the employment conditions within the (semi-)collective sector of the countries until further notice. The implementation of this Decree is conditional on the granting of liquidity support. Aruba has requested the RMR to agree to the partial phasing out of the country’s implemented salary discount of 12.5% ​​for all employees in the (semi) public sector and 25% for Members of Parliament and Ministers, starting with a reduction of respectively 6.25% and 12.5% ​​in 2022. In light of the still fragile public finances with a very high government debt-to-GDP ratio of around 114% of the Gross Domestic Product, the pressure that a reduction of the salary cut in the budget and the repayment capacity and the fact that Aruba has requested to be allowed to deviate from the budget norms on the basis of Article 23 LAft, a reduction of the salary discount is not obvious at the moment. The RMR has therefore not yet agreed to this request. As long as liquidity support is provided from the Netherlands, phasing out is in any case not an option. With a view to offering perspective, I am prepared to discuss with the countries under which conditions the salary discount can be phased out over time. In the meantime, Aruba can make proposals for an alternative interpretation of the salary discounts, as long as that interpretation is in line with the decision of the RMR of 15 May 2020.

Vanaf april 2020 hebben de autonome landen Aruba, Curaçao en Sint Maarten (hierna: de landen) ruim € 1 miljard liquiditeitssteun ontvangen voor het opvangen van de financieel-economische effecten van de Covid-19 pandemie . Dit geschiedde na besluitvorming hiertoe in de Rijksministerraad mede op basis van de adviezen van het College (Aruba) financieel toezicht (C(A)ft) en rapportages van de Tijdelijke Werkorganisatie van het ministerie van BZK (TWO).
De verstrekking van liquiditeitssteun was voorafgegaan door toestemming van de Rijksminsterraad (RMR) aan de landen om te mogen afwijken van de centrale begrotingsnormen voor de begrotingsjaren 2020 en 2021. Voor Curaçao en Sint Maarten betrof het de begrotingsnormen uit artikel 15 van de Rijkswet financieel toezicht Curaçao en Sint Maarten (Rft). Aruba mocht in deze jaren afwijken van de normen zoals die zijn opgenomen in artikel 14 van de Landsverordening Aruba financieel toezicht (LAft) en het Protocol Aruba en Nederland 2019-2021.
Hierover bent u de afgelopen jaren geïnformeerd.

In de RMR 4 februari jl. lag besluitvorming voor over de verzoeken van de landen om ook voor het begrotingsjaar 2022 te mogen afwijken van de begrotingsnormen. Daarnaast heeft besluitvorming plaatsgevonden over het verzoek van Aruba om de salariskorting voor medewerkers in de (semi-) publieke sector en voor ministers en Statenleden af te mogen bouwen vanaf 2022. Deze salariskorting was onderdeel van de besluitvorming in de RMR van 15 mei 2020 over de tweede tranche liquiditeitssteun. Met deze brief informeer ik uw Kamer over de besluitvorming van 4 februari jl. alsook over de verlenging van het protocol Aruba en Nederland 2019-2021.

Verlenging protocol Aruba-Nederland 2019-2021
Op 20 januari 2022 zijn de regeringen van Aruba en Nederland overeengekomen dat de looptijd van Protocol Aruba Nederland 2019-2021 “Inkadering van het pad richting solide, transparante en houdbare overheidsfinanciën van Aruba” (hierna: het protocol) met twee jaar verlengd wordt tot 31 december 2023. Ook is afgesproken dat het protocol vervalt als de Rijkswet Aruba financieel toezicht (RAft) waarvan het voorstel spoedig met uw Kamer zal worden gedeeld, eerder dan 31 december 2023 in werking treedt. Met deze verlenging zijn de begrotingsnormen vastgesteld waarop de Rijksministerraad de begroting van Aruba van 2022 en 2023 kan toetsen.

Toepassing artikel 25 van de Rft en artikel 23 LAft en mate van afwijking
Vanwege de aanhoudende effecten van de coronacrisis op de begrotingen van de landen heeft de Rijksministerraad conform advies van het C(A)ft ingestemd met een afwijking van de begrotingsnorm zoals vervat in artikel 15 van de Rft voor Curaçao en Sint Maarten en van de norm voor het van toepassing zijnde financieringssaldo zoals vervat in artikel 14 van de LAft en het protocol voor Aruba. De toegestane mate van afwijking van de norm is, net als in eerdere jaren, voor het begrotingsjaar 2022 gelijkgesteld aan het totaal van leningen die het land aangaat voor het doen van uitgaven gedurende 2022 met correctie voor de verandering in het liquiditeitssaldo van het land aan het einde van het jaar. De hierboven genoemde leningen vereisen voorafgaande instemming van de RMR.

Afbouw van de salariskorting
Bij de besluitvorming over de tweede tranche liquiditeitssteun op 15 mei 2020 heeft de RMR besloten tot een korting op de arbeidsvoorwaarden binnen de (semi-)collectieve sector van de landen tot nader order. De uitvoering van dit besluit is voorwaardelijk gesteld aan de toekenning van liquiditeitssteun. Aruba heeft de RMR verzocht om in te stemmen met het gedeeltelijk afbouwen van de door het land doorgevoerde salariskorting van 12,5% voor alle medewerkers in de (semi)publieke sector en 25% voor Statenleden en Ministers, te beginnen met een afbouw van respectievelijk 6,25% en 12,5% in 2022. In het licht van de nog altijd kwetsbare overheidsfinanciën met een zeer hoge overheidsschuldquote van circa 114% van het Bruto Binnenlands Product, de druk die een afbouw van de salariskorting op het budget en de aflossingscapaciteit zou hebben en het gegeven dat Aruba heeft verzocht om op grond van artikel 23 LAft te mogen afwijken van de begrotingsnormen, ligt een afbouw van de salariskorting op dit moment niet voor de hand. De RMR heeft met dit verzoek dan ook nog niet ingestemd. Zolang er vanuit Nederland liquiditeitssteun wordt verstrekt, ligt afbouw in ieder geval niet in de rede. Met het oog op het bieden van perspectief ben ik bereid met de landen te bezien onder welke condities de salariskorting op termijn kan worden afgebouwd. In de tussentijd kan Aruba wel voorstellen doen voor een alternatieve invulling van de salariskortingen, zolang die invulling past binnen het besluit van de RMR van 15 mei 2020.

Tot slot is de RMR geïnformeerd over de bestuurlijke overeenstemming over Rijkswet houdende regels omtrent de instelling van het Caribisch orgaan voor hervorming en ontwikkeling (Rijkswet COHO). Uw Kamer zal het voorstel voor deze Rijkswet op zeer korte termijn ontvangen.

Ton Rooijers sworn in by the President of the Court

Ton Rooijers was sworn in on Friday by the President of the Court, Mauritsz de Kort, in the position of Director of Operations of the Joint Court of Justice of Aruba, Curaçao and Sint Maarten and of Bonaire, Sint Eustatius and Saba. This was announced on Wednesday.

He will fulfill this position as of 1 February and will also be a member of the Board of the Court as of this date. Rooijers has been appointed for a period of five years.

Before this, Rooijers worked for years in the judiciary. From January 2013 to December 2021 he worked as a board member of the court in Rotterdam. Before this position, he worked for 11 years at the court in Haarlem as director of operations and board member.

435 kg of cannabis seized at sea off Guadeloupe

On the night of February 11, during an air-sea surveillance patrol led by the Armed Forces in the Antilles (FAA), the surveillance frigate Germinal intervened on a suspicious fast boat without visible nationality mark on the high seas in the south- west of Guadeloupe. The go-fast fled when the soldiers approached, while throwing bundles into the sea. The five occupants were stopped and 11 bundles were recovered and tested positive for cannabis, representing 435 kg.

On the instructions of the public prosecutor of Fort-de-France, the narcotics, the boat and the suspects were handed over to the Caribbean branch of the anti-narcotics office (OFAST). This operation was carried out under the direction of the prefect of Martinique, delegate of the Government for the action of the State at sea and the commander of maritime zone of the Antilles.

This second seizure of the year 2022 for the FAA follows the operation carried out by Germinal on January 29 which made it possible to recover 680 kg of cocaine from the hands of drug traffickers. The seizure of February 11 represents for them a loss of more than one million euros for goods that were probably intended for West Indian consumers.

Today the Government of Aruba announced changes in the measures against COVID19 and therefore Aruba Airport Authority N.V. (AAA) hereby informs about the measures for all Queen Beatrix International Airport users as of tomorrow February 17, 2022:

AAA as manager and operator of Aruba’s only airport will maintain all preventive and safety measures in all Restricted Areas (inside the Terminal Building: Local Immigrations, Local Customs, Security, US CBP area, all Gates, and Main Concession area) until March 1, 2022, to continue protecting its operation, all employees, and travelers.

This means that the use of a face mask is recommended in all office areas, check-in areas, and arrivals areas, but is mandatory in all Restricted Areas (inside the Terminal Building: Local Immigrations, Local Customs, Security, US CBP area, all Gates, and Main Concession area) until March 1, 2022.

In the meantime, AAA will continue monitoring the global aviation situation before changing its current measures.

For us, it was a question of exposing the overall problem of the succession and the probable irregularities that were identified in the procedure. We were understood and heard. As we requested, a mission from the General Inspectorate of Justice supported by other administrations should be sent to Saint-Martin very soon. It will be a question of taking into account all the problems of the land of the island and more particularly the situation of this succession. In the meantime, a legal procedure firmly supported by the rights holders concerned is necessary in support of this mission. It should lead to a more favorable situation for the family. We remain mobilized so that protective law and republican justice bring serenity to our territory. #Saint-Martin

Cet après-midi le Préfet Serge Gouteyron, Randy et Rinaldo Webster et moi-même avons été reçus par les conseillers du Garde des Sceaux.

Il s’agissait pour nous d’exposer la problématique globale de la succession et les probables irrégularités qui ont été repérées dans la procédure. Nous avons été compris et entendus. Tel que nous l’avons demandé, une mission de l’inspection générale de la justice appuyée d’autres administrations devrait être envoyée à Saint-Martin tout prochainement. Il s’agira de prendre en compte toute la problématique du foncier de l’île et plus particulièrement la situation de cette succession. En attendant, une procédure judiciaire solidement portée par les ayants-droit concernés est nécessaire en appui de cette mission. Elle devrait permettre d’aboutir à une situation plus favorable pour la famille. Nous restons mobilisés pour que le droit protecteur et la justice républicaine ramènent la sérénité sur notre territoire. #SaintMartin
