US GOVERNMENT CALLS ON AMERICANS TO STOP TRAVELING TO CURAÇAO

WASHINGTON DC – The American RIVM (the CDC) has labeled Curaçao as a very high-risk area and has colored it dark red on the map (Level 4) because of an increase in infections. Americans are strongly advised not to travel to Curaçao.

After there were practically no infections on the island for months, there has been an increase since mid-July. While the numbers are still well below their early April peak, and most of the population is now vaccinated, that’s no reason for the CDC to forgo Level 4.

Subsequently, the State Department (the Ministry of Foreign Affairs) also adjusted the travel advice. It is a downer for Curaçao, because American tourists are a main source of income. At the same time, not all Americans will care.

The other Caribbean islands in the Kingdom have less negative travel advice. Saba and St. Eustatius are classified in Level 1 (low risk), Bonaire in Level 2 (limited risk) and Aruba and St. Maarten in Level 3 (high risk, but no problem if you are fully vaccinated).

Incidentally, the Netherlands has been classified as Level 4 (very high risk) for much longer, but the consequences are limited because American tourists are not important for the economy.

WASHINGTON, USA – On July 29, 2021, the executive board of the International Monetary Fund (IMF) concluded the Article IV consultation discussions with the Kingdom of the Netherlands – Curaçao and Sint Maarten and endorsed the staff appraisal without a meeting on a lapse-of-time basis. These consultation discussions form part of the Article IV consultation with the Kingdom of the Netherlands.

The COVID-19 pandemic inflicted another major shock on the economies of Curaçao and Sint Maarten. It followed major hurricanes in Sint Maarten in 2017 and the spillovers of the Venezuelan crisis on Curaçao that caused a decline of the oil refining sector, one of Curaçao’s major economic pillars. The pandemic led to a collapse of tourism in both countries. Despite significant response measures swiftly designed by the authorities and financed by the Netherlands, real GDP is estimated to have fallen 20 percent in Curaçao and 24 percent in Sint Maarten in 2020 due to the high dependence on tourism.

A particularly severe outbreak of COVID-19 in Curaçao in March-April 2021 required a near-lockdown and brought tourism to a halt again. A combination of depressed fiscal revenue and higher spending needs due to COVID-19 response measures widened fiscal deficits in 2020, increasing government debt stocks to about 89 and 65 percent of GDP in Curaçao and Sint Maarten, respectively.

The economic recovery is likely to be protracted as tourism is expected to reach its pre-pandemic levels only in 2024. Zero real GDP growth is projected in Curaçao in 2021 due to the effects of the COVID-19 outbreak, followed by 6.5 percent growth in 2022 as tourism partially recovers. Unless the refinery resumes operations in a sustainable way, it could take a decade for real GDP to recover to its pre-pandemic (2019) level as the refinery-related sectors decline.

In Sint Maarten, real GDP growth is projected at 4 percent in 2021 and 15 percent in 2022 driven by the recovery of tourism and the implementation of post-hurricane projects including reconstruction of the airport. Real GDP is likely to recover to the pre-pandemic level in 2024. In both countries, inflation is likely to accelerate in 2021 due to higher fuel and other import prices. Elevated primary fiscal deficits in 2021 are likely to increase the government debt ratios to 103 and 82 percent of GDP in Curaçao and Sint Maarten, respectively, although the debt ratios would gradually decline in the medium term as fiscal deficits subside and the economies recover. The outlook is subject to elevated uncertainty and risks, including the risk of another COVID-19 outbreak and delays in securing the required liquidity support.

Executive board assessment

The comprehensive economic support measures, put in place with help from The Netherlands, cushioned the COVID-19 shock and saved livelihoods. They supported employment and helped avoid mass bankruptcies. However, the economic contraction was severe and the outlook is challenging and subject to elevated uncertainty and risks.

The near-term focus should be on safe reopening of the economies, providing support where necessary, and setting the stage for inclusive recovery and medium-term sustainability. Accelerating vaccination campaigns, particularly in Sint Maarten, would support recovery of the hospitality sector. It would be important to provide adequate resources to critical areas such as the health sector, tax administration, AML/CFT, and data and information frameworks. Agreements with The Netherlands (landspakketten) present a window of opportunity to implement structural reforms to support a recovery and ensure medium-term sustainability.

Strong implementation of fiscal reforms and a sustainable economic recovery are needed to achieve medium-term debt sustainability. Both countries need to strengthen tax administration as a matter of urgency and implement tax policy reforms to widen the tax base. It is essential to strengthen public financial management through better planning, stronger expenditure controls, better tracking of fiscal risks, and improved transparency. In the long term, both countries would benefit from moving towards a Fiscal Responsibility Framework including government debt as a long-term anchor. As the debt anchor of 40 percent of GDP recommended previously is unfeasible unless a part of liquidity support is converted into grants, the new target can be set when uncertainty subsides.

Monetary policy should aid the recovery while supporting the peg. The excess liquidity should be monitored closely and sterilized if the international reserves come under pressure. The CBCS is encouraged to remove capital flow measures introduced in March 2020 as soon as the recovery takes hold and if the international reserve cushion remains comfortable. Staff does not recommend approval of the exchange restriction as the conditions for approval are not met.

The authorities’ efforts to address financial sector vulnerabilities are welcome and need to be sustained to address the banking sector fragilities. Developing a comprehensive Financial Sector Reform Program was a significant step forward. Careful sequencing of measures and implementation would be key for addressing the vulnerabilities. Efforts to transition to risk-based supervision, strengthen supervisory enforcement, and upgrade the bank resolution framework should be frontloaded. The CBCS should develop a roadmap for addressing results of a planned asset quality review.

Finding new areas of growth, supported by strong across-the-board structural reforms, would help mitigate exposure to shocks and boost potential growth. The authorities could foster new areas of growth by improving the business environment and reducing the cost of doing business. Facilitating various permits – including through better transparency and eliminating red tape -would increase incentives for investment, including FDI. Phasing in more labor market flexibility while fine-tuning safety nets and addressing skills gaps would improve competitiveness and adaptability. Expanding green energy (such as solar and wind) or pursuing green projects could generate new investment.

Significant efforts are needed to improve planning, implementation capacity, and governance in the public sector, particularly in Sint Maarten. As gaps in data availability and quality hamper effective macroeconomic analysis and policymaking, it is essential to address the shortages of personnel and financial resources in this area. https://www.sxmgovernment.com

CAY HILL: In light of the rise in active cases of COVID-19 and the prevalence of the highly contagious delta variant, St. Maarten Medical Center (SMMC) has postponed all non-urgent and elective admissions to the Medical/Surgical Department effective immediately. Patients whose appointments have been postponed will be contacted by the hospital ahead of their scheduled appointment date and time.

Appointments at SMMC’s other Inpatient Departments (Obstetrics/Gynecology and Pediatrics) and the Outpatient Department (Policlinics) will continue as planned. Patients visiting SMMC are asked to ensure that they fill out the COVID-19 screening questions truthfully, that their masks are worn correctly and that social distancing rules and guidelines are adhered to. Only persons with appointments may be allowed to enter the building with the exception of minors and medically indicated companions. Persons who refuse to comply or cooperate may be kindly asked to leave the premises.

SMMC also reminds the public that patient visiting hours have been suspended. Persons with friends or family admitted to SMMC are asked to make use of text messages and phone and video calls where possible to keep in touch with their loved ones. Persons wishing to receive an update on a patient must contact the patient’s emergency contact (which is typically a spouse or immediate family member) as SMMC does not provide patient information to third parties in an effort to protect and uphold patient confidentiality and their patients’ right to privacy.

SMMC apologizes for any inconvenience this may cause and thanks to the public for their cooperation as they provide quality care close to home while keeping their staff and patients safe.

A decline that is marking time, in favor of stabilizing the situation for 3 weeks. This high plateau must call for the greatest caution, given the tense situation in mainland France and in the other French territories of the Caribbean.

Saint-Martin :

For the week of July 12 to 18, 2021 (week 28, data stopped on July 18), there are 51 new cases in the territory of Saint-Martin, a stable figure this week again since 53 new cases were identified in week 27, knowing that the number of tests remained at a high level with 2,615 tests carried out during the week. At the same time, 47 new positive cases were recorded by Public Health France (SPF) 1. Taking into account the consolidated data from the previous weeks, this brings to 2,481 the number of cumulative cases of coronavirus confirmed in the territory (SI-DEP SPF data).

It should be noted that since 07/19/2021 (current week 29), 12 new cases of COVID have been recorded out of 457 analyzes carried out.

Saint-Barthélemy:

For week 28 (data stopped on July 18), there are 5 new cases in the territory of Saint-Barthélemy, 8 new positive cases are recorded by SPF in parallel. This brings the number of cumulative confirmed coronavirus cases to 989 (SI-DEP SPF data).

Since 07/19/2021 (current week 29), 12 new cases of COVID have been recorded out of 203 analyzes carried out, seeming to show a sharp increase in the circulation of the virus in this territory.

Hospitalized and deceased

The CH Louis-Constant Fleming and the CH de Bruyn remain very committed to the management of the crisis. As of July 19, 6 confirmed COVID patients are hospitalized at the LCF hospital (knowing that they were still 9 on July 18). 2 EVASAN were carried out last week and one was done on the 19th.

Monitoring of indicators

The ARS vigilantly monitors the indicators set up for the monitoring of deconfinement:

Two thresholds are set, a vigilance threshold of 10/100 000 inhabitants and an alert threshold of 50/100 000 inhabitants. A high incidence rate reflects the development of clusters or active viral circulation.
-The positivity rate which measures the number of people positive for Covid-19 / the number of tests carried out over a week. Two thresholds are set, a vigilance threshold of 5% and an alert threshold of 10%.

In Saint-Martin,

Epidemiological indicators are stable this week, but vigilance is still required to avoid a further deterioration of the health situation. Indeed, the situation remains fragile and can change very quickly. According to SI-DEP ARS data, the incidence rate, down slightly this week, is still above the alert threshold, standing at 142.7 / 100,000 this week 28 against 148.3 / 100,000 in week 27 .
According to SI-DEP SPF data, the weekly incidence rate is also down slightly; it stands at 133.02 / 100,000 inhabitants in week 28, compared to 144.34 / 100,000 in week 27.

According to SI-DEP ARS data, the weekly positivity rate is up slightly, below the vigilance threshold again this week, with a rate of 2% in week 28 (vs 1.8% in week 27).
According to SPF data, the positivity rate is also slightly higher, with a rate of 3.35%, compared to 3.27% week 27.

The indicators, although stabilized, remain worrying this week again. The situation demands our full vigilance. We must therefore continue the efforts made daily while respecting barrier gestures!

Equally important is understanding the value of getting vaccinated in order to prevent the spread of the disease in its most severe forms. Fragile people, of all ages, often carriers of chronic diseases, must take particular care to protect themselves through barrier gestures but also by limiting physical contact (hugs, hugs, etc.). Willemstad/Philipsburg – In response to current media reports, Centrale Bank van Curaçao en Sint Maarten (CBCS) is issuing the following statement.

On July 4, 2018, an emergency regulation was issued by the Court of First Instance of Curaçao in respect of, among others, ENNIA Caribe Leven NV and ENNIA Caribe Holding NV (ENNIA). The purpose of the emergency regulation is to restructure ENNIA in order to restore its solvency in the interest of, among others, ENNIA’s policyholders.

As part of these efforts, all options are being considered that may contribute to a successful restructuring. Among the options being considered is the possible sale of some of ENNIA’s assets, which include the shares held by ENNIA in Banco di Caribe (BdC). BdC is not subject to the emergency regulation and, as previously announced, neither was there any need for such a measure in BdC’s case. As an asset, BdC makes a positive contribution to the Ennia Group. Such a sale of BdC would generate revenues benefitting the restructuring process.

CBCS will focus its restructuring efforts solely on the best interests of ENNIA’s policyholders and, insofar as BdC is concerned, also BdC’s depositors.

De CBCS is een zelfstandig bestuursorgaan dat, op basis van een onderlinge regeling tussen landen van het Koninkrijk, het Centrale Bank-Statuut, haar werkzaamheden verricht in de jurisdicties van de landen Curaçao en Sint Maarten. Goed beschouwd betekent het dat de CBCS haar werkzaamheden doet op basis van een dubbele set regels. Immers, de landen Curaçao en Sint Maarten zijn autonome landen binnen het Koninkrijk met eigen wetten en regels.

Gelukkig hebben de wetgevers van Curaçao en Sint Maarten in artikel 3, tweede lid van het Centrale Bank-Statuut vastgesteld dat “De Landen zullen waarborgen dat hun nationale wetgeving, voor zover in relatie tot de doelstellingen van de Bank, en de daarop berustende uitvoeringsbepalingen, eenvormig en verenigbaar zijn [..], alsmede een gelijkluidende ingangsdatum bevatten”.

Deze verzameling bevat alle regels die van toepassing zijn op de Bank. Uit het woord ‘regels’ valt af te leiden dat het niet alleen gaat om wetten (landsverordeningen) maar ook om alle daarop berustende uitvoeringsregels. Dit kunnen zijn landsbesluiten, houdende algemene maatregelen, maar ook zogenaamde beleidsregels. Kortom, een breed scala aan regels waar de onder toezicht vallende instellingen, maar ook de Bank, zich aan dienen te houden. Ook moet worden opgemerkt dat uit doelmatigheids- en efficiëntieoverwegingen slechts die delen van wetteksten zijn overgenomen die daadwerkelijk van toepassing zijn op de werkzaamheden van de Bank. Als voorbeeld kan verwezen worden naar het toezicht dat de Bank uitoefent op het fonds BVZ. Slechts de artikelen die handelen over toezicht door de Bank zijn in deze verzameling opgenomen en niet de hele landsverordening.

Deze verzameling is met de nodige zorg tot stand gebracht. Echter, duidelijk moet zijn dat op het moment van publicatie de inhoud al verouderd kan zijn. Daar valt niets aan te doen. Regelgeving is een dynamisch proces en deze wordt steeds gewijzigd en geactualiseerd door nieuwe ontwikkelingen en inzichten. De bedoeling is dan ook om deze verzameling regelmatig te actualiseren. Het voorgaande is derhalve ook een waarschuwing; hetgeen in dit overzicht staat kan inmiddels al weer gewijzigd zijn. Verificatie van informatie is daarom altijd gewenst.

Desalniettemin zijn wij van mening dat met deze verzameling van de regelgeving aan een grote behoefte wordt voldaan. Immers, Bankmedewerkers moeten steeds weer terugvallen op de rule of law. Met deze verzameling is de toegankelijkheid tot de relevante en van toepassing zijnde regels sterk toegenomen. En dat draagt weer bij aan het leveren van een beter product door de Bank.

The Minister of Public Health, Social Development and Labor, (VSA) Omar Ottley signed a scope of service agreement (SOS) with Indigo Shores Developments B. V. The SOS brings the vision of this luxurious hotel one step closer to reality.

The scope of service agreement ensures not only economical benefits for Sint Maarten but also the employment of our local labor force.

According to the SOS, Indigo Shores Developments B.V. agreed to hold job fairs that will take place on three occasions. The first one being at the start of the construction phase, followed by the finishing phase and operational phase.

The Developers also agreed to work along with the National Institute for professional Advancement (NIPA) to offer training opportunities for unskilled job seekers in the local labor market in Sint Maarten.
This will not only strengthen the current labor market but it will also ensure that the skilled labor resources of Sint Maarten increases.

Minister Ottley stated that he was happy when Indigo Shores Developments B.V. agreed to ensure the usage of local heavy equipment for their project, once they are readily available.

Indigo Shores Developments B.V. stated that preference will be allotted to the use of local machinery and trucks. These negotiations will commence once the project begins. This Development is estimated to create about 200 job opportunities and has an operational arrangement with the Government of St. Maarten under the auspices of VSA, which guarantees that the majority of employment goes to the local labor force.

Ministry of VSA and Justice sign policy to combat domestic violence, child abuse and gender based violence on Sint Maarten.

On June 30th 2021, the Honorable Minister of Justice, Anna E. Richardson together with the Honorable Minister of Public Health, Social Development and Labor (VSA), Omar Ottley signed off on an official policy that was commissioned by both Ministries to strengthen government’s response to combat Domestic Violence (DV), Child Abuse (CA) and Gender based Violence (GBV) through legislation and procedures that prevents their occurrence.

The objective of the policy is to regulate the legal and social procedural actions to prevent, treat and punish the violence observed in this policy and is essential to earmark the various forms of violence and highlight the Government of Sint Maarten’s commitment to ensure that they are eradicated from our society.

To ensure such, the policy entails a categorization of violence by degrees. The three (3) degrees in which these violent acts can be distinguished are first, second and third degree. Each degree of violence is defined through the severity of actions and will be punishable by law in accordance to the penalties that are charged by it. Perpetrators of domestic violence and/or child abuse that have committed legal crimes in all degrees can face charges based on each degree, thus augmenting the punishment.

Minister Richardson lauded the commencement of this policy as a step in the right direction for the people of Sint Maarten. “Having such a policy in place ensures a level of responsibility is taken by the Government of Sint Maarten to address these issues and take measures to ensure a more safe and secure community. These atrocious actions that plague communities create long-term effects that we need to address now so that our communities won’t have to face them later or become victims.”

The Ministry of VSA is committed to being involved in addressing these negative occurrences which can have traumatic and extensive impacts on the victims of these egregious acts. “I believe that this policy is a milestone for Sint Maarten and I am honored to be a part of the process. These matters have always been areas of concern and this policy paves the way for implementing pragmatic and effective solutions.” stated Minister Ottley.

At current, there are 16 policy commitments, which together work to combat domestic violence, child abuse and gender-based violence. These commitments commence with the strengthening of the legal environment, but stretches to ensure better systems for prevention, protection, confidential reporting and treatment for victims, witnesses and the perpetrator.

It is the intention of the Government of Sint Maarten to provide better opportunities for children to grow up in a safer environment, especially in their own homes. In addition, we intend to change the behavior and attitude towards violence in our society for all persons regardless of age, gender, disability, income, ethnicity or other status.

By implementing an integrated policy as such, it has proven to lend its support to the Government’s policy on Sexual and Reproductive Health, Youth Policy, National Protocol on Child Abuse and Disaster Management.

Through this collaborative effort, Minister Richardson and Minister Ottley hope to be able to effectively enable a proactive approach that tackles the issue of Domestic Violence, Child Abuse, and Gender Based Violence, inevitably reducing the amount of victims and reports on the island.

“The finalization and ratification this policy is in perfect alignment with the finalization and the establishment of the Victim Support Services (VSS). This policy lends added procedural structure to the service and support that VSS will render to victims in our communities” stated Minster Richardson.

Both ministers have committed to taking all the necessary steps and have pledged to actively work towards ending this threat to the residents of Sint Maarten.

In closing, Minister Richardson and Minister Ottley would like to thank all civil servants and external partners of the Ministries who were a part of the process in having this very important policy developed.
