Cooperation arrangement guaranteeing plans for tackling national tasks Curaçao and Sint Maarten (hereinafter: Cooperation arrangement) in force. This stipulates that for the national tasks that Curaçao and Sint Maarten were not yet able to properly perform at the time of the constitutional reform, there is an action plan to work towards independent implementation of the national task.

The Cooperation Arrangement gives the option to extend the arrangement by two years if not all plans have been completed within the term. Extension by Royal Decree has previously taken place in 2012, 2014, 2016, 2018 and 2020. The current period of validity of the Cooperation Regulation runs until October 10, 2022. In consultation with Sint Maarten, the intention was expressed during a Ministerial Consultation on March 23, Cooperation arrangement to be extended again.

State of affairs Curaçao
The Curaçao Progress Committee noted in February 2017 that all action plans for the country’s tasks in Curaçao have been implemented. The Curaçao Progress Committee has ended its activities on June 1, 2017. Since then, the Cooperation Arrangement no longer has any meaning for Curaçao.

State of affairs Sint Maarten
Sint Maarten has completed three of the original five action plans for the implementation of national tasks. Only the action plans for the prison system and the police are still being implemented.

Since the previous extension of the Cooperation Arrangement, the Netherlands and Sint Maarten have collaborated intensively on the remaining action plans. As explained in the letter of the written consultation Sint Maarten on 11 February.

In its most recent report3, the Sint Maarten Progress Committee notes that for the first time since the reconstruction phase, significant progress is visible in the implementation of the action plans. Despite this, the Progress Committee has concluded that both the prison system action plan and the police action plan will not be completed before October 10, 2022.

The advice of the Progress Committee and the progress of the action plans were discussed in the Ministerial Consultation between Sint Maarten and
The Netherlands on March 23, 2022, at which the Prime Minister and Minister of Justice from Sint Maarten, as well as myself and the Minister for Legal Protection were present. During this consultation, all those present endorsed the importance and urgency of completing the remaining action plans. Both the Netherlands and Sint Maarten have expressed their commitment to continue the current cooperation, aid and assistance, where desired and possible.

I would emphasize once again that the extension of the Cooperation Regulation from the Netherlands provides an important basis for sustainable cooperation to strengthen the prison system and the police force on Sint Maarten. The need for this reinforcement arises, among other things, from reports from the Progress Committee, the Law Enforcement Council, the European Court of Human Rights and the Public Prosecution Service. The construction of a new prison, about which talks with the United Nations Office for Project Services (UNOPS) are still ongoing, is an important benchmark. In the meantime, Sint Maarten must ensure that the current facilities are also sufficiently equipped, in line with the tasks as set out in the plan v.an approach to the prison system and the police. The Netherlands offers both financial and personnel support for this.

Amvrb renewal process
On Wednesday 25 May, the Kingdom Council of Ministers approved the extension of the Amvrb. In accordance with Article 42, fourth paragraph, of the Amvrb, both Houses of the States General must be notified in every decision to terminate or extend the Amvrb. In addition, the extension of the decision must be announced no later than two months before the expiry of the current term (10 August 2022). The draft Royal Decree regulating this extension is attached to this letter.

During the Ministerial Consultation of March 23, Sint Maarten and the Netherlands also agreed to evaluate the current Amvrb for its practical implementation and to propose adjustments where desired. A desired adjustment, also in consultation with the Progress Committee, is to

reporting frequency from four times to twice a year. This reduction relieves Sint Maarten from the regulatory burden and promotes greater focus on the implementation of the remaining plans of approach. The reporting frequency remains in line with the commitment to submit progress reports on the implementation of the action plans to the Senate twice a year.

Samenwerkingsregeling waarborging plannen van aanpak landstaken Curaçao en Sint Maarten (hierna: Samenwerkingsregeling) van kracht. Hierin is vastgelegd dat er voor de landstaken die Curaçao en Sint Maarten op het moment van de staatkundige hervorming nog niet naar behoren konden uitvoeren, een plan van aanpak is om toe te werken naar zelfstandige uitvoering van de landstaak.

De Samenwerkingsregeling geeft de mogelijkheid om de regeling te verlengen met twee jaar wanneer niet alle plannen binnen de termijn afgerond zijn. Verlenging per koninklijk besluit heeft eerder plaatsgevonden in 2012, 2014, 2016, 2018 en 2020. De huidige werkingsduur van de Samenwerkingsregeling loopt tot 10 oktober 2022. In samenspraak met Sint Maarten is tijdens een Ministerieel Overleg op 23 maart jl. de intentie uitgesproken om de Samenwerkingsregeling opnieuw te verlengen.

Stand van zaken Curaçao
De Voortgangscommissie Curaçao heeft in februari 2017 geconstateerd dat alle plannen van aanpak landstaken Curaçao zijn uitgevoerd. De Voortgangscommissie Curaçao heeft haar werkzaamheden per 1 juni 2017 beëindigd. Sindsdien heeft de Samenwerkingsregeling geen betekenis meer voor Curaçao.

Stand van zaken Sint Maarten
Sint Maarten heeft drie van de oorspronkelijke vijf plannen van aanpak voor de uitvoering van landstaken afgerond. Alleen de plannen van aanpak voor het gevangeniswezen en de politie zijn nog in uitvoering.

Sinds de vorige verlenging van de Samenwerkingsregeling hebben Nederland en Sint Maarten intensief samengewerkt op de resterende plannen van aanpak. Zoals toegelicht in de brief van het schriftelijk overleg Sint Maarten op 11 februari jl.
en aangegeven tijdens het commissiedebat op 26 mei 2021 en de begrotingsbehandeling van 14 oktober 2021 heeft Nederland op het detentiedossier onder andere bijgedragen door korte-termijnsteun te bieden via de bekostiging van een programmamanager en HR-adviseur, evenals opleidingen van personeel en bouwkundige verbeteringen. In haar meest recente rapportage3 constateert de Voortgangscommissie Sint Maarten dat voor het eerst sinds de wederopbouwfase significante voortgang zichtbaar is in de uitvoering van de plannen van aanpak. Desondanks komt de Voortgangscommissie tot de constatering dat zowel het plan van aanpak gevangeniswezen als het plan van aanpak politie niet vóór 10 oktober 2022 zullen zijn voltooid.

Het advies van de Voortgangscommissie en de voortgang van de plannen van aanpak zijn besproken in het Ministerieel Overleg tussen Sint Maarten en
Nederland van 23 maart 2022, waarbij de minister president en minister van Justitie vanuit Sint Maarten, evenals ikzelf en de minister voor Rechtsbescherming aanwezig waren. Tijdens dit overleg hebben alle aanwezigen het belang en de urgentie van de voltooiing van de resterende plannen van aanpak onderschreven. Hierbij hebben zowel Nederland als Sint Maarten hun commitment uitgesproken om de huidige samenwerking, hulp en bijstand, daar waar gewenst en mogelijk, voort te zetten.

Ik benadruk nogmaals dat verlenging van de Samenwerkingsregeling vanuit Nederland een belangrijke grondslag biedt voor een duurzame samenwerking ter versterking van het gevangeniswezen en het politiekorps op Sint Maarten. De behoefte tot deze versterking komt onder andere voort uit rapportages van de Voortgangscommissie, de Raad voor de Rechtshandhaving, het Europees Hof voor de Rechten van de Mens en het Openbaar Ministerie. De bouw van een nieuwe gevangenis, waarover de gesprekken met de United Nations Office for Project Services (UNOPS) nog gaande zijn, vormt hierbij een belangrijk ijkpunt. In de tussentijd moet Sint Maarten waarborgen dat de huidige faciliteiten ook voldoende zijn toegerust, in lijn met de opgaven zoals gesteld in het plan van aanpak gevangeniswezen en politie. Nederland biedt hiervoor zowel financiële als personele ondersteuning.

Proces tot verlenging Amvrb
De Rijksministerraad heeft op woensdag 25 mei jl. ingestemd met de verlenging van de Amvrb. Conform artikel 42, vierde lid, van de Amvrb dienen beide Kamers van de Staten-Generaal gekend te worden in ieder besluit tot beëindiging of verlenging van de Amvrb. Daarnaast dient de verlenging van het besluit uiterlijk twee maanden voor het verstrijken van de huidige termijn (10 augustus 2022) bekendgemaakt te worden. Het ontwerp van het koninklijk besluit dat deze verlenging regelt treft u bij dit schrijven aan.

Tijdens het Ministerieel Overleg van 23 maart jl. zijn Sint Maarten en Nederland tevens overeen gekomen de huidige Amvrb te evalueren op de praktische uitvoering en daar waar gewenst aanpassingen voor te stellen. Een gewenste aanpassing, mede in consultatie met de Voortgangscommissie, is om de

rapportagefrequentie te verlagen van viermaal naar tweemaal per jaar. Deze verlaging ontlast Sint Maarten in regeldruk en bevordert meer focus op de uitvoering van de resterende plannen van aanpak. De rapportage-frequentie blijft in lijn met de toezegging om de voortgangsrapportages over de uitvoering van de plannen van aanpak tweemaal per jaar aan de Eerste Kamer te doen toekomen .
