The Chief of Police,
taking into account
– the General Administrative Law Act;
– the Police Act 2012;
– the Charter for the Kingdom of the Netherlands;
– the National Act on the Police of Curaçao, Sint Maarten and Bonaire, Sint Eustatius and Saba (Kingdom Act
Police);
– the Protocol on specialized investigation cooperation between the countries of the Kingdom (Protocol);
– the Mandate decision management RST 2020 of the Minister of Justice and Security; and
– the January 2020 Police Mandate Decree;
considering:
– that on the basis of an amendment to the Protocol on specialized investigation cooperation between the countries of the Kingdom, the Minister of Justice and Security is responsible for the care and maintenance of an investigation cooperation team (Government Gazette 26 July 2019, no. 38964);
– that the Minister of Justice and Security, with the Mandate Decree on the management of RST 2020 of 10 June 2020 (Government Gazette 2020 no. 33182), has given substance to the assignment agreed in the Protocol to the Chief of Police, on behalf of the Minister, for the management of the RST;
– that the RST team chief, in consultation with the police chief, shapes the operational management of the RST with the personnel and resources made available to the RST by the police chief on behalf of the Minister;
– to this end, the Chief of Police wishes to grant sub-mandate to the RST team chief for the powers mandated by the Minister with regard to the management of the RST and for his decisions on objection, partly with the intervention of a sub-mandate to an official designated by him;
– that police officers are made available by the chief of police to the RST team chief and are deployed as an employee of the RST on the basis of an individual posting to perform the tasks assigned to the RST under the Police Act and the Protocol about which they are accountable to the RST team chief;
– that it is necessary for the RST team chief to exercise a number of mandate powers on behalf of the Chief of Police as the competent authority;
– that the Chief of Police has decided to grant a separate mandate to the portfolio holder Caribbean part of the Netherlands Kingdom the authority to take a decision on a notice of objection submitted against personnel decisions of the team chief RST;
– that the RST primarily, but not exclusively, uses the facilities of the police for the performance of its tasks and that the present mandate decision supports the RST team chief to this end by mandating him with all necessary powers with his consent and acceptance;
– that this separate (sub) Mandate Decree for Police Management RST 2021 provides for a mandate to the RST team chief with regard to management pertaining to his field of activity and the associated budget responsibility; and
– that the RST Team Chief is accountable to the Chief of Police regarding the implementation of the mandate granted, partly on the basis of reports on the people and resources made available; decides to adopt the following (sub) mandate decision
CHAPTER 1. DEFINITIONS
Article 1 Definitions
In this decision, the following terms have the following meanings:
a. Barp: Decree on general legal position of the police;
b. GDP: Police Remuneration Decree
c. Chief of Police: Chief of Police as referred to in Article 27 of the Police Act 2012;
d. mandate: authority to make decisions on behalf of the police chief;
e. Mandate decision management RST: Mandate decision management RST 2020 of the Minister;

f. Mandate decision for the police: Mandate decision for the police January 2020;
g. Minister: Minister of Justice and Security;
h. PDC: Police Service Center as referred to in Article 36 of the Police Management Decree;
i. police: national police force as referred to in Article 25, paragraph 1 of the Police Act 2012;
j. portfolio holder for the Caribbean part of the Netherlands Kingdom: the officer designated as such by the chief of police;
k. Protocol: Protocol on specialized investigation cooperation between the countries of the
Kingdom of Aruba, Curaçao, Sint Maarten and the Netherlands;
l. RST: a criminal investigation cooperation team as referred to in Article 57a of the Police Act and Article 6 of the
Protocol;
m. team chief RST: head of the RST as referred to in Article 7 of the Protocol;
Article 2 Laws and regulations
This Decree relates to powers and duties that are vested in the police chief by or pursuant to the Police Act 2012 and under a sub-mandate pursuant to the Protocol. This decision should therefore be read in conjunction with the Police Mandate Decree.
Article 3 Power of attorney and authorization
For the purposes of this Decree and the provisions based on it, the granting of a mandate also includes the granting of:
a. power of attorney: the power to conduct legal acts under private law on behalf of the police to perform;
b. authorization: the power to perform acts on behalf of the police or the chief of police that are neither an administrative decision nor a legal act under private law, including in any case representing the police or the chief of police in (judicial) proceedings and out of court;
c. the power to take a procedural decision in civil proceedings.
The director of the PDC manages the register in which the maximum amounts associated with the power of attorney of all managerial officers are kept for each job level. This register is available for inspection at the PDC. An overview of the amounts associated with the team leader RST is included in Appendix 1 to this mandate decision.
CHAPTER 2. TEAM CHEF RST
Article 4 Mandate for investigative cooperation
1. The RST team chief is given a (sub) mandate with regard to matters pertaining to his field of activity and the associated budget responsibility, with due observance of the provisions of the RST Management Mandate Decree and the provisions of this mandate decision.
2. With regard to employees of the RST who are appointed to the police, with a view to exercising personal powers on the basis of the first paragraph, the RST team chief is given a mandate to take decisions relating to:
– the years of service (chapter III Barp);
– (holiday) leave (chapters IV and VI Barp);
– functioning and assessment (art. 71 Barp);
– a statement of satisfaction, extra leave or bonus (art. 74 second paragraph under a to c);
– a performance or substitution allowance, during and for a maximum of the duration of the period of posting (Articles 16 and 17 of the Bbp);
– an order measure (art. 73, 84 and 85 Barp) or a reliability investigation (art. 8b Barp); – a study facility (art. 58 Barp);
– a transfer in the interest of the service (art. 64 Barp);
– rules regarding good official conduct (§ 1 of chapter VII.a Barp);
– the determination of a work-related accident or occupational disease (art. 54 Barp); and
– decisions in case of illness less than 6 months (§ 1 of Chapter VII Barp);
e.e.a. as also included in the individual provisioning agreement.
3. With regard to employees of the RST who are appointed to the police, with a view to the exercise of personal powers by the RST team chief on the basis of the first paragraph, decisions that are reserved for the police chief, members of the police chief, police chief and directors as referred to in in the Police Mandate Decree.
4. The RST team leader is authorized to act as the principal towards the PDC for the delivery of products and services, within the limits of the established staffing and budget of the RST. In cases where provision of services to the RST from the PDC is practically impossible or is disproportionately burdensome in terms of time or money, the RST team chief is authorized to conclude agreements on site within the scope of his budget and the provisions of the first paragraph.
5. Where possible, the RST team leader exercises the mandate within the policy applicable within the police. If the full application of that policy results in the RST not being able to properly perform its statutory duties, the RST team chief, with the consent of the police chief, may decide to deviate from the policy in individual cases.
6. Decisions taken by the RST team chief on the basis of paragraphs 1 and 2 shall be signed as follows: “The police chief, on his behalf the RST team chief,

Article 5 Mandating other investigative cooperation
1. Within the limits of the established formation and budget of the RST, a mandate is given to the team leader RST to temporarily support a local police force in the Caribbean part of the Netherlands Kingdom with personnel and resources already made available to him. to be supplied on the basis of the order of the Minister as referred to in Article 18 of the Protocol.
2. The mandate referred to in the first paragraph is not granted with regard to the additional provision of personnel and resources to the RST from the Netherlands. With the intervention of the portfolio holder of the Caribbean part of the Netherlands Kingdom, a separate assessment is reserved for the Chief of Police for this purpose. If the Chief of Police makes additional personnel and resources available from the police on the basis of Article 18 of the Protocol, the RST Team Chief is given a mandate to take care of the management of the personnel and resources made available to a local police force.
Article 6 Instructions, frameworks and guidelines
1. The RST team chief exercises the (sub) mandate in accordance with the instructions of the police chief.
2. Proposed decisions that deviate from the instructions referred to in the first paragraph must be approved by the police chief.
Article 7 P last substitute
The powers that are (sub) mandated in this decision also accrue to the deputy of the team chief RST, if and insofar as he acts as such.
CHAPTER 3. WALLET HOLDER CARIBBEAN PART OF THE DUTCH KINGDOM
Article 8 Mandate
1. The portfolio holder in the Caribbean part of the Netherlands Kingdom is given a mandate to take decisions on objections submitted by police officers against personnel decisions of the RST team chief as referred to in Article 4, second paragraph.
2. Decisions taken by the portfolio holder of the Caribbean part of the Netherlands Kingdom on the basis of this article will be signed as follows:

Article 9 RST management consultation
The portfolio holder of the Caribbean part of the Netherlands Kingdom is given a mandate to participate on behalf of the Chief of Police in the consultations as referred to in Article 13, paragraph 4, under b of the Protocol, with a view to the responsibilities for making personnel and resources available as referred to in Article 12, paragraph 4, of the Protocol.
Article 10 Instructions, frameworks and guidelines
1. The portfolio holder in the Caribbean part of the Netherlands Kingdom exercises the (sub) mandate with due observance of the instructions of the Chief of Police.
2. Proposed decisions that deviate from the instructions referred to in the first paragraph must be approved by the police chief.
CHAPTER 5 FINAL PROVISIONS
Article 11 Official title
This decision can be cited as: (Sub) Mandate Decree for Police Management RST 2021.
Article 12 Entry into force
This decision will enter into force on the day after it is published and has a retroactive effect until 27 July 2019.

EXPLANATORY STATEMENT
General
The investigation cooperation team – hereinafter referred to as: RST – is a partnership established by the countries of the Kingdom of the Netherlands, established on the basis of Article 57a of the Police Act and the Amendment to the Protocol on specialized investigation cooperation between the countries of the Kingdom (Government Gazette 26 July 2019, No. 38964) – hereinafter referred to as the Protocol. The RST is operationally positioned as an independent and recognizable operating entity.
However, it uses the facilities of the police for the performance of its duties
The management of the RST is mandated by the Minister of Justice and Security – the Minister – with the Mandate Decree management RST 2020 of 10 June 2020 (Government Gazette 2020 no. 33182) to the Chief of Police in (the European part of) the Netherlands. . This means that by making personnel and resources available, the police enables the RST to perform its tasks under the Police Act and the Protocol and that the RST makes use of the infrastructure of the police for this purpose, where possible. .
There is a so-called double mandate line. The Chief of Police grants sub-mandate to the RST Team Chief for the management of the RST, which has been mandated by the Minister. In addition and at the same time, the Chief of Police, insofar as it concerns his own personnel and resources, gives a direct mandate to exercise powers on his behalf to the RST team chief. A specific mandate is granted for the personal powers as a competent authority.
The RST team leader is responsible for the day-to-day management of the RST, including operational management. For example, he also has personal responsibility for employees who work locally in the police forces in the countries of the Kingdom and for employees who are made available to him other than by the police chief. For the police officers made available to him, the RST team chief, as the hiring party for day-to-day personnel care, must be able to take a number of personnel decisions on the spot on behalf of the police chief.
Article 4
In this article, the Chief of Police gives a mandate to the RST team chief to make decisions regarding personnel and resources belonging to the police.
Member 1
The RST is an independent entity set up by the countries of the Kingdom, which the Minister has placed with the police for administrative purposes. This positioning concerns accommodation, other support facilities, ICT resources and support in the implementation of financial and HRM decisions that are entrusted to the RST team leader.
The field of activity of the RST as referred to in this article pertains to the management of the RST with regard to the tasks referred to in Article 57a of the Police Act and Article 6, second paragraph of the Protocol.
The formation for the RST with which the formation of the police in the Netherlands was incorporated ehoogd, is part of the formation of the police. The budget for personnel costs associated with this formation for the RST is therefore also part of the budget of the police. The RST is funded with a “special contribution” from the budget of the Ministry of Justice and Security.
On the basis of the first paragraph, the RST team chief obtains a mandate and a sub-mandate. This also includes the personnel powers with regard to a number of RST employees who are directly employed by the RST and the powers he exercises on behalf of the RST as a hiring party in the secondment of police and other officials to the RST. The scope of the mandate is specified in paragraphs 2 to 4 for the personal powers with regard to police officers.
Paragraph 2
The employees made available to the RST from the European part of the Netherlands who are appointed to the police are seconded as police officers by the police chief as the competent authority in order to be deployed to carry out the tasks of the RST. They are accountable to the RST team leader for the activities to be performed by them for the benefit of the RST.
In view of the desired operational independent and independent position of the RST, the RST team leader must be able to act on a mandate as a competent authority within the meaning of the legal status regulations for a number of specific personnel powers for the police officers on the spot. that apply to these employees. The individual provisioning agreements are geared to this. The RST team leader makes comparable agreements on behalf of the RST as the hiring party with other organizations that supply civil servants to the RST.
The set of specific personnel powers to be exercised on site by the RST team chief means that the RST team chief is also authorized to initiate an investigation of the facts in the event of a suspicion of breach of duty or to initiate a criminal investigation in the event of a suspicion of a breach of duty. an offense involving a posted police officer. To this end, the RST team leader can request advice and support from the VIK team of the staff of the unit of the police and HRM Labor Affairs Department of the PDC. Investigations take place according to the rules that apply within the police. The RST team chief submits the outcome of an investigation with advice to the police chief of the unit from which the police officer was made available. On the basis of his personnel mandate, this police chief is authorized to take decisions based on the results of this investigation.
Police officers are temporarily employed by the RST under the direction and supervision of the RST team chief, but remain employed by the police as a lending party. The police chief remains their formal employer without prejudice. The legal position of police officers is primarily governed by the official appointment with the police and the legal status conditions based on this. In the individual agreements prior to the actual making available, the applicability of additional employment conditions related to the specific work to be performed at the RST is confirmed.
The other, regular personnel decisions will be taken by or on behalf of the police chief or director of the department from which the employees are made available to the RST, except for the cases included in this mandate decision. In view of the geographical distance in this article, the Chief of Police has directly mandated the RST team chief in day-to-day personnel management to exercise a number of specific personnel powers. This corresponds to the content of the individual agreements for making available.
Furthermore, the Chief of Police grants a separate central mandate to the portfolio holder of the Caribbean part of the Netherlands Kingdom for the exercise of the power to take decisions on objections against decisions taken by the RST team chief within the police force.
Paragraph 4
In order to guarantee the operational independence of the RST, the RST team chief is authorized to act within the force as principal towards the PDC. Within the police, various procedures, rules and policy standards apply in the various PIOFACH areas. These form the framework for the application of powers by all mandates within the force, including for the RST team chief.
In principle, the RST team leader takes the standard offer of the PDC as the starting point. Only if this leads to the RST not being able to perform its tasks properly can the RST team chief, with the consent of the police chief, decide that a tailor-made assignment must be carried out. provided. In addition, it may be appropriate that the RST team leader must conclude an agreement with a view to supporting the performance of tasks on site, for example to hire a service or to purchase concrete products. For these cases, framework agreements can be made between the RST and the PDC with the consent of the Chief of Police.
Article 5
The Netherlands, Aruba, Curaçao and Sint Maarten provide each other with help and assistance (Article 36 of the Charter for the Kingdom of the Netherlands). The Minister of Justice of a country can request assistance for temporary support for the criminal investigation department in that country (Article 38 of the Netherlands Police Act of Curaçao, St. Maarten and Bonaire, St. Eustatius and Saba and Article 18 Protocol).
The Minister may instruct the Chief of Police to make personnel or resources available if a police force needs temporary support for investigations in the short term when conducting investigations into crimes other than those referred to in Article 6 Protocol, if this is the local legal order. serious shocks (Article 18 Protocol). Pursuant to paragraph 5 of Article 18 Protocol, in Article 5 of this Mandate Decree, the Chief of Police mandates the RST Team Chief to make personnel and resources available on his behalf.

If, on the basis of Article 5, paragraph 2 of this Mandate Decree, the Minister instructs the Chief of Police to make personnel and resources available, management decisions with regard to these additional personnel and / or resources made available will be made with the intervention of the Caribbean part portfolio holder. of the Netherlands Kingdom mandated to the team chief RST. With this mandate, the intended management streamlining of the deployment of criminal investigation capacity from the police in the Caribbean is made possible.
Article 6
The RST primarily uses police resources. For the proper performance of the RST, it may also be necessary to attract non-police people and resources. The powers required for this rest with the Minister on the basis of the Protocol. In the Mandate Regulation for the management of RST 2020, the Minister has mandated these powers to the Chief of Police. Through this article, the Chief of Police mandates these powers in full to the Team Chief RST.

De korpschef van politie,
gelet op
– de Algemene wet bestuursrecht;
– de Politiewet 2012;
– het Statuut voor het Koninkrijk der Nederlanden;
– de Rijkswet politie van Curaçao, van Sint Maarten en van Bonaire, Sint Eustatius en Saba (Rijkswet
politie);
– het Protocol inzake gespecialiseerde recherchesamenwerking tussen de landen van het Koninkrijk (Protocol);
– het Mandaatbesluit beheer RST 2020 van de Minister van Justitie en Veiligheid; en
– het Mandaatbesluit politie januari 2020;
overwegende:
– dat op grond van een wijziging van het Protocol inzake gespecialiseerde recherchesamenwerking tussen de landen van het Koninkrijk de Minister van Justitie en Veiligheid verantwoordelijk is voor de zorg voor en instandhouding van een recherchesamenwerkingsteam (Stcrt. 26 juli 2019, nr. 38964);
– dat de Minister van Justitie en Veiligheid met het Mandaatbesluit beheer RST 2020 van 10 juni 2020 (Stcrt. 2020 nr. 33182) invulling heeft gegeven aan de in het Protocol overeengekomen opdracht aan de korpschef namens de Minister zorg te dragen voor het beheer van het RST;
– dat de teamchef RST in overleg met de korpschef de bedrijfsvoering van het RST vorm geeft met de door de korpschef namens de Minister aan het RST ter beschikking gestelde personeel en middelen;
– dat de korpschef daartoe voor de door de Minister gemandateerde bevoegdheden ten aanzien van het beheer van het RST ondermandaat wenst te verlenen aan de teamchef RST en voor diens beslissingen op bezwaar, deels met tussenkomst van ondermandaat aan een door hem aan te wijzen functionaris;
– dat ambtenaren van politie door de korpschef aan de teamchef RST ter beschikking worden gesteld en als medewerker van het RST op grond van een individuele terbeschikkingstelling worden ingezet voor het uitvoeren van de op grond van de Rijkswet politie en het Protocol aan het RST toegekende taken waarover zij verantwoording schuldig zijn aan de teamchef RST;
– dat het noodzakelijk is dat de teamchef RST voor de dagelijkse personeelszorg namens de korpschef als bevoegd gezag een aantal bevoegdheden in mandaat kan uitoefenen;
– dat de korpschef heeft besloten de bevoegdheid tot het nemen van een beslissing op een bezwaarschrift ingediend tegen personeelsbesluiten van de teamchef RST afzonderlijk mandaat te verlenen aan de portefeuillehouder Caribisch deel van het Nederlands Koninkrijk;
– dat het RST primair, doch niet uitsluitend, gebruik maakt van de voorzieningen van de politie voor de uitvoering van zijn taken en dat het onderhavige mandaatbesluit de teamchef RST daartoe ondersteunt door hem met diens instemming en aanvaarding alle benodigde bevoegdheden te mandateren;
– dat met dit afzonderlijke (onder)Mandaatbesluit Politie beheer RST 2021 wordt voorzien in een mandaat aan de teamchef RST ten aanzien van beheer behorend bij zijn werkterrein en de daarbij behorende budgetverantwoordelijkheid; en
– dat de teamchef RST over de uitvoering van het verleende mandaat mede aan de hand van rapportages over de ter beschikking gestelde mensen en middelen verantwoording aflegt aan de korpschef; besluit vast te stellen het navolgende (onder)mandaatbesluit
HOOFDSTUK 1. BEGRIPSBEPALINGEN
Artikel 1 Definities
In dit besluit wordt verstaan onder:
a. Barp: Besluit algemene rechtspositie politie;
b. Bbp: Besluit bezoldiging politie
c. korpschef: korpschef als bedoeld in artikel 27 Politiewet 2012;
d. mandaat: bevoegdheid om namens de korpschef besluiten te nemen;
e. Mandaatbesluit beheer RST: Mandaatbesluit beheer RST 2020 van de Minister;

f. Mandaatbesluit politie: Mandaatbesluit politie januari 2020;
g. Minister: minister van Justitie en Veiligheid;
h. PDC: Politiedienstencentrum als bedoeld in artikel 36 Besluit beheer politie;
i. politie: landelijk politiekorps als bedoeld in artikel 25, eerste lid Politiewet 2012;
j. portefeuillehouder Caribisch deel van het Nederlands Koninkrijk: de functionaris die als zodanig door de korpschef van politie is aangewezen;
k. Protocol: Protocol inzake gespecialiseerde recherchesamenwerking tussen de landen van het
Koninkrijk Aruba, Curaçao, Sint Maarten en Nederland;
l. RST: een recherchesamenwerkingsteam als bedoeld in artikel 57a Rijkswet politie en artikel 6 van het
Protocol;
m. teamchef RST: hoofd van het RST als bedoeld in artikel 7 van het Protocol;
Artikel 2 Wet- en regelgeving
Dit besluit heeft betrekking op bevoegdheden en taken die bij of krachtens de Politiewet 2012 en in ondermandaat op grond van het Protocol aan de korpschef toekomen. Dit besluit dient uit dien hoofde gelezen te worden in samenhang met het Mandaatbesluit Politie.
Artikel 3 Volmacht en machtiging
Voor de toepassing van dit besluit en de daarop berustende bepalingen wordt onder de verlening van mandaat mede begrepen het verlenen van:
a. volmacht: de bevoegdheid om namens de politie privaatrechtelijke rechtshandelingen te verrichten;
b. machtiging: de bevoegdheid om namens de politie dan wel de korpschef handelingen te verrichten die noch een bestuursrechtelijk besluit noch een privaatrechtelijke rechtshandeling zijn, waaronder in ieder geval het vertegenwoordigen van de politie dan wel de korpschef in (gerechtelijke) procedures en buiten rechte;
c. de bevoegdheid tot het nemen van een procesbesluit in civiele procedures.
De directeur PDC beheert het register waarin per functieniveau de maximale bedragen verbonden aan de volmacht van alle leidinggevende functionarissen worden bijgehouden. Dit register ligt ter inzage bij het PDC. Een overzicht van de bij de teamchef RST behorende bedragen is opgenomen in Bijlage 1behorend bij dit mandaatbesluit.
HOOFDSTUK 2. TEAMCHEF RST
Artikel 4 Mandaatverlening recherchesamenwerking
1. Aan de teamchef RST wordt (onder)mandaat verleend ten aanzien van aangelegenheden die behoren tot zijn werkterrein en de daarbij behorende budgetverantwoordelijkheid, met inachtneming van hetgeen is bepaald in het Mandaatbesluit beheer RST en het bepaalde in onderhavig mandaatbesluit.
2. Ten aanzien medewerkers van het RST die zijn aangesteld bij de politie wordt met het oog op het op grond van het eerste lid uitoefenen van personele bevoegdheden aan de teamchef RST mandaat verleend voor het nemen van besluiten die betrekking hebben op:
– de diensttijd (hoofdstuk III Barp);
– het (vakantie)verlof (hoofdstuk IV en VI Barp);
– het functioneren en de beoordeling (art. 71 Barp);
– een tevredenheidsbetuiging, extra verlof of gratificatie (art. 74 tweede lid onder a t/m c);
– een functionerings- of een waarnemingstoelage, tijdens en maximaal voor de duur van de periode van terbeschikkingstelling (artt 16 en 17 Bbp);
– een ordemaatregel (artt. 73, 84 en 85 Barp) of een betrouwbaarheidsonderzoek (art. 8b Barp); – een studiefaciliteit (art. 58 Barp);
– een verplaatsing in het belang van de dienst (art. 64 Barp);
– regels omtrent goed ambtelijk handelen (§ 1 van hoofdstuk VII.a Barp);
– de vaststelling van een dienstongeval of beroepsziekte (art. 54 Barp); en
– besluiten in geval van ziekte minder dan 6 maanden (§ 1 van hoofdstuk VII Barp);
e.e.a. zoals tevens is opgenomen in de individuele terbeschikkingstellingsovereenkomst.
3. Ten aanzien medewerkers van het RST die zijn aangesteld bij de politie wordt met het oog op het op grond van het eerste lid uitoefenen van personele bevoegdheden door de teamchef RST uitgezonderd besluiten die zijn voorbehouden aan korpschef, leden korpsleiding, politiechef en directeuren als bedoeld in het Mandaatbesluit politie.
4. De teamchef RST is bevoegd om binnen de grenzen van de vastgestelde formatie en het vastgestelde budget van het RST op te treden als opdrachtgever richting het PDC voor de levering van producten en diensten. In gevallen waarin dienstverlening aan het RST vanuit het PDC praktisch niet mogelijk is of onevenredig bezwarend in tijd of geld, is de teamchef RST binnen de reikwijdte van zijn budget en het bepaalde in het eerste lid ter plaatse bevoegd overeenkomsten te sluiten.
5. De teamchef RST oefent het mandaat waar mogelijk uit binnen het binnen de politie geldende beleid. Indien onverkorte toepassing van dat beleid ertoe leidt dat de RST zijn wettelijke taken niet naar behoren kan uitvoeren, kan de teamchef RST, met instemming van de korpschef, besluiten tot afwijking van het beleid in individuele gevallen.
6. Besluiten die op basis van het eerste en tweede lid door de teamchef RST worden genomen, worden als volgt ondertekend: ‘De korpschef van politie, namens deze de teamchef RST,

Artikel 5 Mandaatverlening overige recherchesamenwerking
1. Aan de teamchef RST wordt, binnen de grenzen van de vastgestelde formatie en het vastgestelde budget van het RST, mandaat verleend om ter tijdelijke ondersteuning van een lokaal politiekorps in het Caribisch deel van het Nederlands Koninkrijk reeds aan hem ter beschikking gesteld personeel en middelen te leveren op grond van de opdracht van de Minister als bedoeld in artikel 18 van het Protocol.
2. Het mandaat bedoeld in het eerste lid wordt niet verleend met betrekking tot het additioneel vanuit Nederland ter beschikking stellen van personeel en middelen aan het RST. Daartoe is met tussenkomst van de portefeuillehouder Caribisch deel van het Nederlands Koninkrijk een afzonderlijke afweging voorbehouden aan de korpschef. Indien de korpschef additioneel personeel en middelen vanuit de politie beschikbaar stelt op grond van artikel 18 van het Protocol, wordt aan de teamchef RST mandaat verleend om zorg te dragen voor het beheer van het aan een lokaal politiekorps ter beschikking gestelde personeel en middelen.
Artikel 6 Instructies, kaders en richtlijnen
1. De teamchef RST oefent het (onder)mandaat uit met inachtneming van de aanwijzingen van de korpschef.
2. Voorgenomen besluiten die afwijken van de in het eerste lid bedoelde aanwijzingen, dienen door de korpschef te worden goedgekeurd.
Artikel 7 Plaatsvervanger
De bevoegdheden die in dit besluit worden (onder)gemandateerd, komen ook toe aan de plaatsvervanger van de teamchef RST, indien en voor zover deze als zodanig optreedt.
HOOFDSTUK 3. PORTEFEUILLEHOUDER CARIBISCH DEEL VAN HET NEDERLANDS KONINKRIJK
Artikel 8 Mandaatverlening
1. Aan de portefeuillehouder Caribisch deel van het Nederlands Koninkrijk wordt mandaat verleend tot het nemen van beslissingen op bezwaarschriften die zijn ingediend door ambtenaren van politie tegen personeelsbesluiten van de teamchef RST als bedoeld in artikel 4, tweede lid.
2. Besluiten die op basis van dit artikel door de portefeuillehouder Caribisch deel van het Nederlands Koninkrijk worden genomen, worden als volgt ondertekend:

Artikel 9 Beheeroverleg RST
Aan de portefeuillehouder Caribisch deel van het Nederlands Koninkrijk wordt mandaat verleend tot het namens de korpschef deelnemen aan het overleg als bedoeld in artikel 13, vierde lid onder b van het Protocol met het oog op de verantwoordelijkheden voor het ter beschikking stellen van personeel en middelen als bedoeld in artikel 12, vierde lid van het Protocol.
Artikel 10 Instructies, kaders en richtlijnen
1. De portefeuillehouder Caribisch deel van het Nederlands Koninkrijk oefent het (onder)mandaat uit met inachtneming van de aanwijzingen van de korpschef.
2. Voorgenomen besluiten die afwijken van de in het eerste lid bedoelde aanwijzingen, dienen door de korpschef te worden goedgekeurd.
HOOFDSTUK 5 SLOTBEPALINGEN
Artikel 11 Citeertitel
Dit besluit kan worden aangehaald als: (Onder)Mandaatbesluit Politie beheer RST 2021.
Artikel 12 Inwerkingtreding
Dit besluit treedt in werking op de dag nadat het is gepubliceerd, en werkt terug tot en met 27 juli 2019.

TOELICHTING
Algemeen
Het recherchesamenwerkingsteam – verder te noemen: RST – is een door de landen van het Koninkrijk der Nederlanden vastgesteld samenwerkingsverband dat is ingesteld op grond van artikel 57a Rijkswet politie en de Wijziging van het Protocol inzake gespecialiseerde recherchesamenwerking tussen de landen van het Koninkrijk (Stcrt. 26 juli 2019, nr. 38964) – verder te noemen: het Protocol. Het RST is operationeel gepositioneerd als een zelfstandig en herkenbaar opererende entiteit.
Het maakt echter gebruik van de voorzieningen van de politie voor de uitvoering van haar taken
Het beheer van het RST is door de Minister van Justitie en Veiligheid – de Minister – met het Mandaatbesluit beheer RST 2020 van 10 juni 2020 (Stcrt. 2020 nr. 33182) gemandateerd aan de korpschef van de politie in (het Europese deel van) Nederland. Dit betekent dat de politie met het ter beschikking stellen van personeel en middelen het RST in staat stelt zijn taken op grond van de Rijkswet politie en het Protocol uit te voeren en dat het RST daarvoor, waar mogelijk, gebruik maakt van de infrastructuur van de politie.
Er is sprake van een zogeheten dubbele mandaatlijn. De korpschef verleent aan de teamchef RST ondermandaat voor het van de Minister in mandaat verkregen beheer over het RST. Daarnaast en tegelijkertijd verleent de korpschef voor zover het gaat over zijn eigen personeel en middelen rechtstreeks mandaat om namens hem bevoegdheden uit te oefenen aan de teamchef RST. Voor de personele bevoegdheden als bevoegd gezag wordt een concreet mandaat verleend.
De teamchef RST is belast met de dagelijkse leiding van het RST, waaronder de operationele aansturing. Zo heeft hij ook een personele verantwoordelijkheid voor medewerkers die decentraal bij de korpsen in de landen van het Koninkrijk werkzaam zijn en voor medewerkers die anders dan door de korpschef aan hem ter beschikking zijn gesteld. Voor de hem ter beschikking gestelde ambtenaren van politie dient de teamchef RST als inlenende partij voor de dagelijkse personeelszorg een aantal personeelsbesluiten namens de korpschef ter plaatse te kunnen nemen.
Artikel 4
In dit artikel verleent de korpschef mandaat aan de teamchef RST voor het nemen van besluiten ten aanzien van personeel en middelen die behoren tot de politie.
Lid 1
Het RST is een door de landen van het Koninkrijk ingestelde zelfstandige entiteit, die door de Minister beheersmatig is ondergebracht bij de politie. Deze positionering betreft de huisvesting, overige ondersteunende facilitaire zaken, ICT-middelen en ondersteuning in de uitvoering van financiële en HRM-besluiten die bij de teamchef RST belegd zijn.
Het werkterrein van het RST als bedoeld in dit artikel ziet op het beheer van het RST ten aanzien van de taken genoemd in artikel 57a Rijkswet politie en artikel 6, tweede lid Protocol.
De formatie ten behoeve van het RST waarmee de formatie bij de politie in Nederland is opgehoogd, maakt onderdeel uit van de formatie van de politie. Ook het budget voor personeelskosten dat met deze formatie ten behoeve van het RST is gemoeid is daarmee onderdeel van de begroting van de politie. De financiering van het RST vindt plaats met een ‘bijzondere bijdrage’ vanuit de begroting van het Ministerie van JenV.
Op grond van het eerste lid verkrijgt de teamchef RST mandaat en ondermandaat. Dit omvat tevens de personele bevoegdheden ten aanzien van een aantal RST-medewerkers die rechtstreeks in dienst zijn bij het RST en de bevoegdheden die hij namens het RST uitoefent als inlenende partij bij detachering van ambtenaren van politie en andere ambtenaren aan het RST. Voor de personele bevoegdheden ten aanzien van ambtenaren van politie wordt de omvang van het mandaat in het tweede tot en met vierde lid geconcretiseerd.
Lid 2
De vanuit het Europese deel van Nederland aan het RST ter beschikking gestelde medewerkers die zijn aangesteld bij de politie worden als ambtenaar van politie door de korpschef als bevoegd gezag gedetacheerd om te kunnen worden ingezet voor het uitvoeren van de taken van het RST. Over de door hen ten behoeve van het RST te verrichten werkzaamheden zijn zij verantwoording schuldig aan de teamchef RST.
Gelet op de gewenste operationele onafhankelijke en zelfstandige positie van het RST dient de teamchef RST ten aanzien van het dagelijks personeelsbeheer voor een aantal specifieke personele bevoegdheden voor de ambtenaren van politie ter plaatse in mandaat te kunnen optreden als bevoegd gezag in de zin van de rechtspositionele regelingen die op deze medewerkers van toepassing zijn. De individuele terbeschikkingstellingsovereenkomsten zijn hier op afgestemd. De teamchef RST maakt namens het RST als inlenende partij vergelijkbare afspraken met andere organisaties die ambtenaren aan het RST leveren.
De set specifieke, ter plaatse door de teamchef RST uit te oefenen personele bevoegdheden brengt met zich mee dat de teamchef RST tevens bevoegd is tot het starten van een feitenonderzoek bij een vermoeden van plichtsverzuim of het doen starten van een strafrechtelijk onderzoek bij het vermoeden van een strafbaar feit waarbij een ter beschikking gestelde ambtenaar van politie betrokken is. De teamchef RST kan daartoe advies en ondersteuning vragen van het team VIK van de staf van de eenheid van de politie en Dienst HRM Arbeidszaken van het PDC. Onderzoeken vinden plaats volgens de regels zoals die binnen de politie gelden. De teamchef RST legt de uitkomst van een onderzoek met advies voor aan de politiechef van de eenheid van waaruit de ambtenaar van politie ter beschikking is gesteld. Deze politiechef is op grond van diens personeelsmandaat bevoegd tot het nemen van besluit op basis van de uitkomsten van dit onderzoek.
De ambtenaren van politie worden tijdelijk bij het RST tewerkgesteld onder leiding en toezicht van de teamchef RST, maar blijven in dienst van de politie als uitlenende partij. De korpschef blijft onverminderd hun formele werkgever. De rechtspositie van de ambtenaren van politie wordt primair beheerst door de ambtelijke aanstelling bij de politie en de daarop geënte rechtspositionele voorwaarden. In de individuele overeenkomsten voorafgaand aan het ter feitelijk beschikking stellen wordt de toepasselijkheid bevestigd van aanvullende arbeidsvoorwaarden, die verband houden met de specifieke bij het RST te verrichten werkzaamheden.
De overige, reguliere personeelsbesluiten zullen behoudens de in dit mandaatbesluit opgenomen gevallen worden genomen door of namens de politiechef of directeur van het korpsonderdeel van waaruit de medewerkers aan het RST ter beschikking worden gesteld. Voor het uitoefenen van een aantal specifieke personeelsbevoegdheden heeft de korpschef mede gelet op de geografische afstand in dit artikel de teamchef RST in de dagelijkse personeelszorg rechtstreeks het mandaat verleend. Dit correspondeert met de inhoud van de individuele overeenkomsten voor het ter beschikking stellen.
Verder verleent de korpschef voor het uitoefenen van de bevoegdheid tot het nemen van beslissingen op bezwaar tegen door de teamchef RST genomen besluiten binnen de politie afzonderlijk een centraal mandaat aan de portefeuillehouder Caribisch deel van het Nederlands Koninkrijk.
Lid 4
Om de operationele zelfstandigheid van het RST te kunnen waarborgen, is de teamchef RST bevoegd om binnen het korps op te treden als opdrachtgever richting het PDC. Binnen de politie gelden op de verschillende PIOFACH-terreinen diverse, door de korpschef vastgestelde, procedures, regels en beleidsnormen. Deze vormen de kaders voor de toepassing van bevoegdheden door alle gemandateerden binnen het korps, dus ook voor de teamchef RST.
De teamchef RST neemt in beginsel het standaardaanbod van de PDC als uitgangspunt. Alleen als dit ertoe leidt dat het RST zijn taken niet naar behoren kan uitvoeren kan de teamchef RST, met instemming van de korpschef, besluiten dat er een maatwerkopdracht moet worden verstrekt. Verder kan het aangewezen zijn dat de teamchef RST met het oog op de ondersteuning van de taakuitoefening ter plaatse een overeenkomst dient te sluiten, bijvoorbeeld tot het inhuren van een dienst of aanschaffen van concrete producten. Voor deze gevallen kunnen tussen het RST en de PDC met instemming van de korpschef kaderafspraken worden gemaakt.
Artikel 5
Nederland, Aruba, Curaçao en Sint Maarten verlenen elkaar hulp en bijstand (artikel 36 van Statuut voor het Koninkrijk der Nederland). De minister van Justitie van een land kan een verzoek om bijstand doen voor tijdelijke ondersteuning voor de recherche in dat land (artikel 38 Rijkswet politie van Curaçao, van Sint Maarten en van Bonaire, Sint Eustatius en Saba en artikel 18 Protocol).
De Minister kan de korpschef een opdracht verstrekken om personeel of middelen ter beschikking te stellen, indien een politiekorps op korte termijn tijdelijke ondersteuning nodig heeft voor recherche bij het verrichten van onderzoek naar andere dan de in artikel 6 Protocol genoemde misdrijven, indien die de lokale rechtsorde ernstig schokken (artikel 18 Protocol). Op grond van het vijfde lid van artikel 18 Protocol mandateert de korpschef in artikel 5 van dit Mandaatbesluit de teamchef RST het ter beschikking stellen van personeel en middelen namens hem uit te oefenen.
In de praktijk zal alvorens de Minister op grond van het derde lid van artikel 18 Protocol beslist of dergelijke ondersteuning en op grond van het vierde lid een opdracht verstrekt het verzoek worden besproken met de korpschef van politie in Nederland. Bij het verkrijgen van een opdracht maakt de korpschef de afweging of – en zo ja: op welke wijze – hij ondersteuning kan bieden. Hij doet dit na raadpleging van de portefeuillehouder Caribisch deel van het Nederlands Koninkrijk en de teamchef RST.
Indien op grond van artikel 5, tweede lid van dit Mandaatbesluit, de Minister opdracht verstrekt aan de korpschef personeel en middelen ter beschikking te stellen, worden beheersmatige besluiten ten aanzien van deze additionele beschikbaar gestelde personeel en / of middelen met tussenkomst van de portefeuillehouder Caribisch deel van het Nederlands Koninkrijk gemandateerd aan de teamchef RST. Met dit mandaat wordt de beoogde beheersmatige stroomlijning van de inzet van recherche capaciteit vanuit de politie in de Cariben mogelijk gemaakt.
Artikel 6
Het RST maakt primair gebruik van middelen van de politie. Voor een goede taakuitvoering van het RST kan het daarnaast noodzakelijk zijn om niet-politiële mensen en middelen aan te trekken. De daarvoor benodigde bevoegdheden berusten op grond van het Protocol bij de Minister. In de Mandaatregeling beheer RST 2020 heeft de Minister deze bevoegdheden gemandateerd aan de korpschef. Via dit artikel mandateert de korpschef deze bevoegdheden volledig door aan de teamchef RST.
