William Marlin is to meet with the Governor of Sint Maarten today. It is up to the Governor to decide whether to agree with the Parliamentarians, and allow a new Majority in Government. The Governor also has Article 59.. the option to dissolve government.
On Wednesday as Prime Minister Marcel Gumbs was headed to a U.N. meeting in New York, he learned in San Juan, that his government had collapsed.
Of course he raced back to St Maarten, but too late.
It was only a matter of time, there was a lot of anger and resentment towards the current government. Theo Heyliger the then leader of Government, held the “Article 59 card”.
Article 59 gives the Prime Minister and the Council of Ministers the right to dissolve Parliament, and call for new elections.
With new elections, most in Parliament would lose their seat, so Parliament remained under the threat of dissolution until last Wednesday.
Sarah Wescot Williams (DP), William Marlin (NA) and Frans Richardson (USPP) called a meeting to demand the resignation of Head Antillian Prosecutor Guus Schramm for the honest language that he used in describing the criminal and corrupt St Maarten system. The meeting was also to discuss government owned businesses
The meeting was a ploy, as Marcel Gumbs noted. Not one Minister was invited to the meeting. In the meeting it was announced that Maurice Lake (UPP Parliamentarian), Frans Richardson (USPP leader/ Parliamentarian), and Silvio Matser (UPP Parliamentarian) had joined forced with Sarah Wescot Williams (DP Parliamentarian) and had crossed over to the other side. This move brought down Theo Heyliger’s (UPP) government, and put William Marlin (NA Parliamentarian) in charge of government.
As rumors flew on Wednesday, I went to Parliament to find out what was going on, but most of the Parliamentarians were hiding.
I spoke to some constitutional experts, and we argued as to whether Theo Heyliger would dare use his threat of imposing Article 59, dissolving government, and paving the way for new elections.
The experts believed that Theo would never do it in a million years, I disagreed.
There is no way that Theo, The Watheys and The Meyers would allow William Marlin to become Minister.
As we argued on Thursday, Marcel Gumbs held a supposedly exclusive press briefing. Of course that did not matter, I heard the story as it broke, Marcel Gumbs had formally submitted the Article 59 request to the Governor.
I also noted that the Governor had been incredibly cooperative with William, Sarah and Frans the day before, and that there was a good chance that the Governor would not sign off on the agreement.
And that turned out to also be predictive.
The governor has refused to sign of on the Article 59 request.
Marcel Gumbs and the Council of Minister have refused to resign.
The St Maarten Government is now deeply in the midst of a civil war
The Parliamentarians led by head of the National Alliance William Marlin, head of the DP Sarah Wescot Williams and head of USPP Frans Richardson want to change governments. They would maintain their positions as Parliamentarians but with a new majority, the current Ministers would be out of a job.
The Ministers led by Prime Minister, Marcel Gumbs want a dissolution of Parliament. New elections, meaning that each Parliamentarian would have to re-earn their seat in Parliament, and of course they are afraid of new elections, because they sucked at government. Nothing but bickering and infighting.
Sarah Wescot Williams is saying that Ministers who have been fired, cannot turn around and fire the Parliamentarians who fired them
The legal experts are coming in and saying that Marcel does have a leg to stand on, that he does have the constitutional right to call for new elections.
The governor has REFUSED to sign off on Marcel Gumbs article 59 request.
Marcel Gumbs has REFUSED to resign from his position as Prime Minister.
This battle is about to enter out corrupt court system.
The winner most likely will be whoever pays the Judges and Prosecutors the most, or whoever has the most dirt on them.

But the power will definitely not given to the old regime. Who’s side is the governor on by the way.
