On 11 March last, the Advisory Division of the Council of State on the
Kingdom issued advice on the proposal for a Kingdom Act for the Caribbean Body
reform and development (COHO). Unfortunately I was advised, that less that two weeks later, it had been leaked to the Caribbean media.. This was obviously not the intention. Under the Council Act
van State, an advice from the Advisory Division will only be made public on the
moment that this, together with the accompanying further report and bill, is sent to
the House of Representatives is sent.

I hope to continue this good cooperation in drafting the response
on the advice of the Advisory Division, the further report. This further report and
a COHO proposal adapted on this basis requires the approval of all

Op 11 maart jl. heeft de Afdeling advisering van de Raad van State van het
Koninkrijk advies uitgebracht over het voorstel van rijkswet Caribisch orgaan voor
hervorming en ontwikkeling (COHO). Helaas heb ik moeten vernemen dat het
advies, een kleine twee weken later, in verschillende Caribische media is
uitgelekt. Dit was uiteraard niet de bedoeling. Op grond van de Wet op de Raad
van State wordt een advies van de Afdeling advisering pas openbaar op het
moment dat dit samen met het bijbehorende nader rapport en wetsvoorstel naar
de Tweede Kamer wordt gezonden.
De vertrouwelijkheid van adviezen van de Afdeling advisering heb ik op 18 maart
besproken tijdens een overleg met de ministers-presidenten van Aruba, Curaçao
en Sint Maarten. Dit overleg stond in het teken van het bepalen van het
gezamenlijke proces om te komen tot een reactie op het advies over het COHOvoorstel. Na dit overleg heb ik op 19 maart het advies naar de regeringen van de
Landen gezonden en hebben minister-presidenten Wever-Croes, Rhuggenaath en
Jacobs kennis kunnen nemen van de inhoud hiervan.
Gelet op de ontstane situatie, nu het vertrouwelijke advies is gelekt, heb ik op
advies van de Raad van State van het Koninkrijk en na afstemming met ministerpresidenten Wever-Croes, Rhuggenaath en Jacobs, besloten om bij hoge
uitzondering het voorstel publiek te maken. Deze stap is niet gebruikelijk, maar
vanwege de specifieke aard van consensusrijkswetgeving en in het belang van
een op feiten gebaseerd publiek debat, dat nu in de Landen is ontbrand, heb ik
hier alles afwegend toe besloten. U treft zowel het advies als het wetsvoorstel dat
naar de Raad van State van het Koninkrijk is gegaan voor advisering, aan op
rijksoverheid.nl.
Ik acht het niet zuiver om in deze brief uitvoerig stil te staan bij de inhoud van
het advies en bij de analyses die hierover verschijnen. Zodra overeenstemming is
bereikt over het nader rapport zal de parlementaire behandeling van het voorstel
worden aangevangen. Wel zou ik in aanloop hiernaartoe willen opmerken dat de
kern van het rijkswetsvoorstel overeind blijft in het advies. De Raad van State van
het Koninkrijk vindt het logisch dat Nederland voorwaarden verbindt aan het

dat een consensusrijkswet een passend kader biedt voor de vormgeving hiervan,
in het bijzonder voor de oprichting van een speciaal bestuursorgaan (het COHO).
Verder vind ik het belangrijk om op te merken dat, anders dan de suggestie die
op sommige plaatsen wordt gewekt, het rijkswetsvoorstel volgens de Afdeling
advisering niet in fundamentele zin in strijd is met het Statuut. De Afdeling zet
verschillende kritische kanttekeningen, zowel bij de effectiviteit van het voorstel
als bij de rechtmatigheid hiervan. Maar zij constateert geen principiële strijdigheid
met het Statuut. Het is betreurenswaardig dat dit beeld nu wel gecreëerd is.
We zijn nu al een aantal maanden aan de slag om op basis van de landspakketten
de uitvoeringsagenda vorm te geven. Hierbij wordt stapsgewijs vooruitgang
geboekt. Dit gebeurt, zoals ook de minister-presidenten van Aruba, Curaçao en
Sint Maarten eerder hebben benadrukt, in goede samenwerking met de Landen.
Deze goede samenwerking hoop ik voort te zetten bij het opstellen van de reactie
op het advies van de Afdeling advisering, het nader rapport. Dit nader rapport en
een op basis daarvan aangepast COHO-voorstel, behoeft goedkeuring van alle
vier de Landen. Zodra hierover overeenstemming is bereikt in de
Rijksministerraad, zal het nader rapport, samen met het rijkswetsvoorstel dat het
vergezelt, naar de Staten van Aruba, Curaçao en Sint Maarten en de Tweede
Kamer worden gezonden. Het streven is om dit voor het zomerreces te doen.
