Maximum wages for top earners Sint Maarten (semi-) public entities, Minister Ardwell Irion of Finance reported to the States on Monday. According to The Daily Herald, the bill was the only item on the agenda of the meeting of the Central Committee of Parliament, which was scheduled to discuss a total of four bills. Three of the draft National Ordinances related to austerity measures that the Netherlands had set as a condition for the second tranche of the liquidity support. The draft national ordinance discussed above aims to enforce two of the Dutch conditions. One of these is the “Jacobs standard”, which stipulates that the total package of employment conditions of top officials in public companies and (semi-) public institutions may not exceed 130 percent of the reduced salary of the prime minister. According to another Dutch condition – which is laid down in one of the two other cost-saving draft national ordinances – the total employment conditions packages of political authorities must be reduced by 25 percent. The draft national ordinance discussed Monday will also reduce the total employment conditions package of employees in these entities by 12.5 percent, which is also one of the Dutch conditions. According to Irion, the Jacobs standard figure was calculated by first taking the current total salary and allowances of the prime minister (22,046.36 guilders) and adding this to the total non-cash benefits and pension (18,468.70 guilders). The sum of these numbers was then reduced by 25 percent, after which 30 percent was added, making a total of just over 39,500 guilders. In her presentation to the States, Prime Minister Silveria Jacobs said that the figure of 130 percent also applies to the hourly rates of consultants. In Article 1 of the draft national ordinance, the (semi-) public sector is understood to mean either a legal person established by or pursuant to national ordinance; an institution that is subsidized or financed directly for more than 50 percent by the country of Sint Maarten; or a company incorporated under Book Two of the Dutch Civil Code in which the country of Sint Maarten has shares of more than 50 percent, directly or indirectly. With regard to the cuts in personnel, the draft National Ordinance allows (semi-) government agencies to implement the cuts in the manner regulated in the draft National Ordinance Covid-19 cuts to the employment conditions for civil servants, which is also one of the laws is to cut costs. However, entities are free to deviate from this as long as the cuts reach the 12.5 percent cut, Jacobs said, adding that the legal minimum wage is the bare minimum for gross monthly salaries by law. Een daarvan is de ‘Jacobs-norm’, die bepaalt dat het totale arbeidsvoorwaardenpakket van topfunctionarissen in overheidsbedrijven en (semi-)openbare instellingen niet meer dan 130 procent van het verlaagde salaris van de premier mag bedragen. Volgens een andere Nederlandse voorwaarde – die in een van de twee andere kostenbesparende ontwerp-landsverordeningen wordt vastgelegd – moeten de totale arbeidsvoorwaardenpakketten van politieke autoriteiten met 25 procent worden verminderd. De ontwerp-landsverordening die maandag is besproken zal ook het totale arbeidsvoorwaardenpakket van werknemers in deze entiteiten met 12,5 procent verminderen, wat ook een van de Nederlandse voorwaarden is. Volgens Irion werd het Jacobs-normcijfer berekend door eerst het huidige totale salaris en de toelagen van de premier (22.046,36 gulden) te nemen en dit toe te voegen aan de totale niet-geldelijke uitkeringen en pensioen (18.468,70 gulden). De som van deze aantallen werd vervolgens met 25 procent verminderd, waarna er 30 procent aan werd toegevoegd, wat een totaal van iets meer dan 39.500 gulden oplevert. In haar presentatie aan de Staten zei premier Silveria Jacobs dat het cijfer van 130 procent ook van toepassing is op de uurtarieven van consultants. In artikel 1 van de ontwerp-landsverordening wordt onder de (semi-)publieke sector verstaan ofwel een bij of krachtens landsverordening ingestelde rechtspersoon; een instelling die voor meer dan 50 procent rechtstreeks wordt gesubsidieerd of gefinancierd door het land Sint Maarten; of een vennootschap opgericht ingevolge Boek Twee van het Burgerlijk Wetboek waarin het land Sint Maarten direct of indirect aandelen heeft van meer dan 50 procent. Voor wat betreft de bezuinigingen op het personeel staat de ontwerp-Landsverordening toe dat (semi-)overheidsinstanties de verlagingen doorvoeren op de wijze die is geregeld in de ontwerp-landsverordening Covid-19-bezuinigingen op de arbeidsvoorwaarden voor ambtenaren, hetgeen eveneens een van de wetten is om kosten te snijden. Het staat de entiteiten echter vrij om hiervan af te wijken zolang de bezuinigingen de korting van 12,5 procent bereiken, zei Jacobs, eraan toevoegend dat het wettelijke minimumloon volgens de wet het absolute minimum is voor bruto-maandsalarissen. De ontwerp-landsverordening wordt met terugwerkende kracht gedateerd op 1 juli 2020, de deadline die de Nederlandse regering oplegde om aan de voorwaarden te voldoen.
