In relation to problems with respect to the poor conditions and insufficient capacity of Point Blanche Prison, the holding of pre-trial detainees in excess of ten days in Philipsburg Police Station.

firmly reiterated their invitation to the authorities to submit information on the additional measures required and envisaged to bring the conditions of detention in Philipsburg Police Station in full conformity with the Convention and the Court’s case-law.
Further invited them to clarify on whether the minimum required personal space has been provided to all detainees and called on them submit complete and up-to-date information on general material conditions in the Philipsburg Police Station.
Enabling the Committee to assess whether these comply with the Convention and the Court’s case-law;

Firmly reiterated their call on the authorities to provide information on the concrete measures taken to ensure that no detainees are held in excess of ten days in the Philipsburg Police Station and to provide the Committee with up-to-date statistical data on the type and number as well as the length of detentions in this facility;
recalling that under the Court’s case-law and the Committee’s recommendations, an appropriate solution for the problem of insufficient capacity is the reduction of the number of prisoners by more frequent use of non-custodial punitive measures.
Encouraged the authorities to further promote the wider use of alternatives to pre-trial detention and imprisonment, for example through legislative amendments and/or specific awareness-raising measures for the relevant actors;

invited the authorities to submit information on further measures taken or envisaged to further increase the number of prison staff employed in the detention facilities on the Sint Maarten and to develop the capacity and role of prison officers;
noted with regret that the UNOPS project agreement has still not been signed, although this was planned to occur in February 2021, and urged the authorities to take all necessary steps to put this project into practice without further delay so that concrete and sustainable progress regarding the restructuring and improvement of the overall detention system on Sint Maarten is achieved;
invited the authorities to provide information on all the above points by 15 December 2022; decided to resume consideration of this case, in the light of the information received, at their DH meeting in December 2023 at the latest.
