1. Process course

For the course of the proceedings in factual instances, the Supreme Court refers to:

  1. the judgment in case AR 2014/18 of the Court of First Instance in Sint Maarten of 21 July 2015;

  2. the judgments in the case AR 18/14 – Ghis 78078 – H 77/16 of the Common Court of Justice of Aruba, Curaçao, Sint Maarten and Bonaire, Sint Eustatius and Saba of 17 November 2017 and 30 July 2019.

ROTW has appealed in cassation against the judgments of the court of appeal.

Het Land et al have concluded that the appeal should be dismissed.

The case was explained for Het Land et al by their lawyer.

The conclusion of the Advocate-General EM Wesseling-van Gent is to reject the appeal in cassation.

The lawyers of ROTW responded in writing to that conclusion.

2Principles and facts

2.1

The following can be assumed in cassation.

(i) On December 13, 2013, the Recipient has imposed an executory attachment against ROTW on items belonging to ROTW in respect of gaming license charges.

(ii) ROTW filed a notice of opposition to the Recipient on January 16, 2014.

(iii) The Recipient has honored the objection insofar as it concerns the collection of assessments imposed before December 2009, and has rejected the other objection.

(iv) The Recipient has suspended the execution but maintained the attachments.

2.2

In these proceedings ROTW claims that the opposition to the coercive recovery be declared well-founded. In so far as relevant in cassation, it argues that the assessments are in conflict with an undertaking made by (the legal predecessor of) the Country. Het Land et al. Defend themselves by relying, among other things, on the formal legal force of the attacks.

The court declared ROTW inadmissible in its claim against the Land and dismissed the claim against the Recipient.

The court has confirmed the court’s verdict. To this end, it considered as follows.

Interim judgment:

“4.2. The GEA has declared ROTW inadmissible in its claim against the Land. Ground 1 of ROTW is directed against this. The Court held on June 9, 2017 (AR 143/14-Ghis 79521-H 211/16), American University v. The Land and the Recipient, ‘that only the Recipient can be sued (compare ECLI: NL: HR: 2003 : AF3638) ‘(legal ground 3.5). The Court is now sticking to this. The complaint therefore fails.

4.10.

For the time being, the Court of Appeal is of the opinion (…) that with regard to the assessment, objection and appeal are open under the National Ordinance on Administrative Jurisprudence, being a legal process with sufficient procedural guarantees. Compare (…) with regard to the Curaçao guest tax, the ruling of this Court in LAR cases of 28 June 2013, ECLI: NL: OGHACMB: 2013: 48.

4.11.

The parties will be given the opportunity to simultaneously take a deed with regard to this matter and then simultaneously a deed of reply. “

Final verdict:

2.1. The Court of Appeal made its provisional judgment in the interim judgment that with regard to the assessment of the gaming license right, objection and appeal are open under the National Ordinance Administrative Jurisprudence (LAR), which is a legal process backed with sufficient procedural guarantees, until a final decision.

2.3.

It has not been established that in the present case there are violations of general principles of good administration that could not have been (timely) submitted to the LAR court. ROTW is therefore inadmissible in its opposition. ”

3Assessment of the remedy

3.1.1

Part 1 of the plea is directed against the judgment of the court of appeal (in ground 4.2 of the interim judgment) that only the Recipient can be summoned and that ROTW is therefore inadmissible in its claim against the Country. According to the section, there is no exclusive standing of the Recipient.

3.1.2

As the Supreme Court ruled earlier – after the interlocutory judgment of the Court of Appeal in this case – with regard to the Aruban collection law 1 , it also applies to the country of Sint Maarten that its collection right does not have a rule as laid down for the Netherlands in art. 3 paragraph 2 Collection Act 1990, meaning that in all legal proceedings arising from the performance of his task the Recipient as such takes legal action, from which provision an exclusive legal standing for the Recipient arises, with the exclusion of the State. In the absence of one with art. 3 paragraph 2 Collection Act 1990 comparable legal provision in Sint Maarten, an exclusive legal standing of the Recipient cannot be assumed. The part is therefore well-founded.

3.2.1

Part 2 complains that the Court of Appeal (in legal ground 4.10 of the interim judgment and legal ground 2.1 of the final judgment) has wrongly ruled that objection and appeal are open against the assessments to play license law imposed on ROTW pursuant to the National Ordinance on Administrative Jurisprudence (hereinafter: LAR). According to the part, since no appeal is available to the tax judge with regard to assessments for playing license law, the civil judge has jurisdiction as residual judge and not the administrative judge.

3.2.2

As appears from the information in the Opinion of the Advocate General under 2.13-2.33, the part rightly takes the starting point – which the Court of Appeal also assumed – that in Sint Maarten there is no legal basis for the jurisdiction of the tax judge with regard to attacks. .

For the answer to the question whether in such a case the civil court or the general administrative court has jurisdiction, the court of appeal has in para. 4.10 of the interim judgment sought connection with a ruling of the court in LAR cases of 28 June 2013 with regard to the Curaçao guest tax 2 . For the meaning of that statement it is important that, as the Court of Appeal in par. 4.8 has considered that the Board of Appeal for Tax Affairs (in another case about the levying of guest tax in Curaçao) ruled in 2012 that the applicable legislation does not contain a provision that makes the Board of Appeal for Tax Affairs competent to rule on disputes about the guest tax in Curaçao. 3In that light, the decision of the Court of Appeal of 28 June 2013 – in which the Court of Appeal as the highest LAR judge has assessed a dispute about the levying of guest tax in Curaçao – has decided that the Court of Appeal, in the absence of an appeal to the tax judge, will LAR judge has deemed competent in this matter.

In the present case, the Court of Appeal has apparently deduced from this judgment that – now with regard to the assessments of the gaming license law in Sint Maarten (just as is the case with the guest tax in Curaçao), there is no legal basis for an appeal to the tax judge – in accordance with case law of the highest LAR court with regard to those attacks on the basis of the LAR, an appeal is available to the administrative court, and that the civil court has no jurisdiction with regard to those attacks. These judgments of the court are correct. Art. 7 paragraph 1 LAR, after all, opens an appeal to the administrative court for those who are directly affected in their interest by a decision (which also includes an assessment of a playing license right), while a tax assessment against which no appeal has been lodged with another administrative court (as is the case with an assessment for a playing license right) does not fall under the provisions of art. 7 paragraph 2 LAR exhaustively included exceptions.

Part 2 therefore fails.

3.3

On the basis of what was considered above in 3.2.2, the Court of Appeal has rightly ruled (in ground 2.3 of the final judgment) that the attacks on playing license rights could have been challenged before the LAR court and that ROTW, now that it has not done so, is inadmissible in its opposition to the civil court.

In view of this, ROTW has no interest in the merits of section 1, since its claim against the Country should fail on the same grounds as its claim against the Recipient. Part 1, although well-founded, cannot therefore lead to cassation.

3.4

The other complaints of the remedy cannot lead to cassation either. The Supreme Court is not required to state reasons why it reached this judgment. When assessing these complaints, it is not necessary to answer questions that are important for the unity or development of the law (see art. 81 paragraph 1 RO).

4Decision

The high Council:

– dismisses the appeal;

– orders ROTW to pay the costs of the proceedings in cassation, estimated until this judgment on the part of the Land et al. at € 882.34 in disbursements and € 2,200 for salary.

This judgment was passed by Vice President CA Streefkerk as chairman and judges TH Tanja-van den Broek and CH Sieburgh, and pronounced in public by Justice MJ Kroeze on April 9, 2021 .

Since 2010, Sint Maarten has been an independent country within the Kingdom of the Netherlands. Due to the economically dire situation on the island due to the corona pandemic and the devastation caused by the hurricane season in 2017, it has to rely on financial loan from the Netherlands. To this end, the Netherlands is forcing reforms that are disproportionate and undemocratic. The parliament of Sint Maarten has therefore filed a complaint with the UN for human rights violations and racism. State Secretary for the Interior and Kingdom Relations Raymond Knops immediately suspended corona support in response to this.

The reforms are said to make the island’s economy and society more sustainable and resilient. Not all proposed reforms are objectionable. “We welcome the reforms, most of which we agree. But there is a thorny thing: three representatives are going to run Sint Maarten, and we have nothing to say, “says one of the initiators of the complaint and Member of Parliament Grisha Heyliger-Marten in the Antilliaans Dagblad:” It feels like slavery again. ” These representatives would be appointed by the Netherlands alone. They monitor the extent to which the reforms are being implemented. If this is not done sufficiently, the financing can be stopped. However, Sint Maarten refused to comply with this state of affairs, and so filed a complaint. The petitioners accuse the Dutch government of a neo-colonial and racist attitude in providing thirty million euros in emergency corona aid. “Instead of providing Covid emergency aid to the predominantly black Dutch residents of Sint Maarten to the same extent and in the same way as the Netherlands helps its predominantly white population (…), the Netherlands has imposed more measures and debts on [the island]”, the report says. complaint filed with the UN. The Parliament of Sint Maarten asks the UN Rapporteur on Racism, Discrimination and Xenophobia, Tendayi Achiume, to investigate these allegations. The aim is to initiate a new discussion about ties with the Netherlands.

Without money support, the treasury is empty after two months, so that salaries of civil servants, among others, can no longer be paid. And the rest of the inhabitants do not receive the supplement to their wages as in the Netherlands. This of course has disastrous consequences such as mass hunger and evictions. But the medical sector, for example, will also come to a complete standstill in the middle of a pandemic.

The Collective Prevention Services (CPS) are monitoring thirty nine (39) people in home isolation. One (1) patient remains hospitalized at the St. Maarten Medical Center. The total number of deaths due to COVID-19 remains at twenty seven (27).

The number of people recovered since the first case surfaced on St. Maarten has increased to two thousand one hundred eighteen (2118). Thirty three (33) people are in quarantine based on contact tracing investigations carried out by CPS.

The Ministry of Public Health, Social Development and Labour (VSA) Airport Health Team in collaboration with Health Care Laboratory Sint Maarten (HCLS) have tested 2655 travelers arriving at the Princess Juliana International Airport (PJIA), while CPS tested 25, 304 people throughout the community. As the numbers continue to fluctuate, CPS will continue to actively execute its contact tracing measures.

In efforts to achieve our ultimate goal of zero active cases, Minister Panneflek encourages everyone to wear your masks, practice social distancing, avoid greeting by hugging and kissing, sanitize or wash your hands frequently, and refrain from mass gatherings’s.

On Friday, April 9th, 13 boxes containing 15,210 doses of the Pfizer/BioNTech COVID-19 vaccine arrived in the country on a KLM flight from the Netherlands. This amount can vaccinate 7,605 persons.

The Collective Prevention Service (CPS) from the Ministry of Public Health, Social Development (Ministry VSA) and the Vaccination Management Team (VMT) are urging the public to register for a vaccine as soon as possible due to the current unprecedented outbreak that is taking place on the island of Curacao.

Curacao is seeing on average over 100 new positive COVID-19 cases each day. On Sunday, there were 4,768 active cases; 129 persons are hospitalized, 44 of them are in the Intensive Care Unit.

The Curacao community is being impacted by the UK variant of the COVID-19 virus. Viruses mutate all the time, and the UK variant is much more contagious which means more people in the community can be infected with the virus and this can have serious implications for the elderly as well as persons with underlying conditions who have not yet been vaccinated.

The UK variant is already in circulation on the island. The main threat for the country is that more people will become ill and that means more people will end up in the hospital, putting pressure on the country’s public health facilities and more people will die.

An outbreak of the UK variant in the country will also have a negative impact on the national economy which in turn will also impact the workforce where it concerns employment.

Vaccines are a critical tool in the fight against the COVID-19 virus and there are clear public health and lifesaving benefits once you are vaccinated.

The Netherlands decided to combine the third and fourth Pfizer batches which would allow CPS and VMT to scale up the administering of the COVID-19 vaccine to members of the community who have registered due to the serious public health situation on Curacao.

Sint Maarten has already received two other batches of the vaccine since February amounting to 15.210 doses.

Members of the community are reminded to register for the COVID-19 vaccine.

Lastly, the paper based “COVID Vaccine Registration Form” can be picked up at several locations, including CPS at the Vineyard Office Park Building, the Division of Labor Affairs at the Simpson Bay Public Service Center in Simpson Bay, doctors’ offices, the Government Administration Building, and select pharmacies.

Even though the current numbers of active cases are now relatively low on St. Maarten, CPS has concluded, based on genotyping results, that the British variant of Covid-19 is now circulating on St. Maarten. At least 24 people have been detected with the British variant. While some of these cases can be linked to travel from Aruba and Curacao, most were residents without a travel history. This indicates that that there is already local transmission of the British variant among the community of St. Maarten.

Curacao, Aruba, and Bonaire are experiencing an explosive rise in Covid-19 infections. In a matter of weeks, the number of active cases in Curacao went from just a handful to more than five thousand due to this more contagious British variant. The result is that Curacao now has code black, with an overfull hospital and one of the highest infection rate rates in the world. It is not unlikely that a similar scenario could happen on St. Maarten within the near future since the British variant is now circulating on our island. Our current vaccination numbers (which are similar to those of Bonaire) are not yet sufficient to prevent a third wave.

It is very important for people to stay vigilant. Please keep your social distance, wear your mask and wash your hands. These three measures are the cornerstone of public health prevention. Please continue to adhere to and comply with the rules.

It is extremely important that if you experience symptoms or you have been in contact with a known case, stay home and please call 914 or your GP. You can get tested free of charge and without an appointment at Point Blanche between 08:30 am – 11:00 am, Monday to Friday starting tomorrow. Free testing is also available on the weekends, but you will need to make an appointment via 914. We would like to remind the public that CPS does not provide pre-travel testing.

In anticipation of the news of the British variant, the VMT decided to immediately scale up the vaccination rate, to make sure that as many persons as possible are protected against this third wave. On Monday, April 12th, the Belair Community Center will scale up from 6 to 8 vaccination lines, which should make it possible to vaccinate a total number of 1000 persons every day collectively between the two vaccination locations.

The situation on the ABC islands has already increased the daily registration numbers on St. Maarten. Where the average daily registrations since the start of the campaign have been around 250 per day, these numbers went up last week with an average of 350-400 persons registering daily. The VMT links this increase directly to the current situation on our sister islands as many people have friends and family living here. More and more people now realize how serious the situation is, and that a similar situation could also happen here. And even though this increased registration rate is a good start, the VMT would like to warn that we still have a long way to go. Currently, we have about 13.000 registrations, while 34.000 fully vaccinated persons (70% of the population) are needed to create herd immunity.

The Pfizer vaccine is effective against the UK variant, but to really have an impact on national transmission, more people need to be vaccinated. To put this in context, we have vaccinated 19% of the population. Bonaire has vaccinated 18% – and yet Bonaire is in the midst of a major outbreak, which indicates that our vaccine coverage is still too low to prevent an outbreak of the UK variant.

Vaccination is now open to all those 18yrs and over, so please register to get your vaccine. Registration is free and vaccination is free. An outbreak, as seen on the ABC islands usually starts slow, but once it’s increasing it is very difficult to stop. Therefore, immediate action is required now, while we still have a grip on the situation.

Both Cole Bay & Dutch Quarter Community Helpdesk’s are currently equipped to provide information and can assist in registration on the spot. On Friday, April 9th, 13 boxes containing 15,210 doses of the Pfizer/BioNTech COVID-19 vaccine arrived in the country on a KLM flight from the Netherlands. This amount can vaccinate 7,605 persons.

The Collective Prevention Service (CPS) from the Ministry of Public Health, Social Development (Ministry VSA) and the Vaccination Management Team (VMT) are urging the public to register for a vaccine as soon as possible due to the current unprecedented outbreak that is taking place on the island of Curacao.

Curacao is seeing on average over 100 new positive COVID-19 cases each day. On Sunday, there were 4,768 active cases; 129 persons are hospitalized, 44 of them are in the Intensive Care Unit.

The Curacao community is being impacted by the UK variant of the COVID-19 virus. Viruses mutate all the time, and the UK variant is much more contagious which means more people in the community can be infected with the virus and this can have serious implications for the elderly as well as persons with underlying conditions who have not yet been vaccinated.

The UK variant is already in circulation on the island. The main threat for the country is that more people will become ill and that means more people will end up in the hospital, putting pressure on the country’s public health facilities and more people will die.

An outbreak of the UK variant in the country will also have a negative impact on the national economy which in turn will also impact the workforce where it concerns employment.

Vaccines are a critical tool in the fight against the COVID-19 virus and there are clear public health and lifesaving benefits once you are vaccinated.

The Netherlands decided to combine the third and fourth Pfizer batches which would allow CPS and VMT to scale up the administering of the COVID-19 vaccine to members of the community who have registered due to the serious public health situation on Curacao.

Sint Maarten has already received two other batches of the vaccine since February amounting to 15.210 doses.

Members of the community are reminded to register for the COVID-19 vaccine.
