No. 08 Temporary National Ordinance of 16 March 2021 laying down rules regarding the remuneration maximum and the adjustment of the employment conditions at (semi) public sector entities (Temporary National ordinance standardization for top incomes and adjustment of employment conditions at (semi) public sector entities)

IN THE NAME OF THE KING!

The Governor of Saint Martin,

Having taken into consideration:

that as a result of the COVID-19 pandemic, the 2020 budget shows a revenue deficit that prevents necessary expenditure from being covered;

that the State of the Netherlands has offered conditional assistance in the form of loans to cover the missing income;

that one of the Dutch conditions is to maximum the remuneration and other terms of employment of the top officials of the public or semi-public sector entities by national ordinance;

that another condition is to reduce the total package of employment conditions for all employees in the (semi-) public sector by national ordinance by 12.5%;

that it is necessary for Sint Maarten to comply with the requirements
conditions for receiving money loans from the State of the Netherlands;

Having heard the Advisory Council, has adopted the following national ordinance in consultation with Parliament:

Chapter 1

Introductory Provisions

Article 1

  1. In this national ordinance and the provisions based on it, the following terms have the following meanings:
    a. (semi) public sector entity:
    1 ° a legal person established by or pursuant to national ordinance as referred to in appendix 1 to this national ordinance;
    2 ° an institution that is subsidized or funded directly for more than fifty percent by the country of Sint Maarten as referred to in appendix 2 to this national ordinance;
    3 ° a company incorporated pursuant to the second book of the Civil Code, in which the country of Sint Maarten has a share of more than fifty percent, directly or indirectly, as referred to in appendix 3 to this national ordinance;
    b. minister: Minister of Finance;
    c. subsidy or funding: a claim based on a decision to financial resources directly at the expense of ‘s Landskas for the performance of certain activities by the person entitled to the claim and whereby the financial means do not serve as payment for the delivery of goods or services to the country Sint
    Maarten;
    d. consultant: hired in externally to carry out work on behalf of the government or a (semi) public sector entity, by a private organization, through the use of personnel capacity and expertise for a fee.
  2. The minister may amend the appendices adopted pursuant to subsection 1 by ministerial regulation.

Chapter 2

Agreement

Article 2

  1. The public or semi-public sector does not agree on any remuneration that per calendar year exceeds the maximum remuneration referred to in Article 3, plus employer’s contributions.
  2. The employer’s contributions, as referred to in the first paragraph, are the social and supplementary insurance policies in which participation is compulsory on the basis of a national ordinance or a generally binding collective labor agreement. Social and supplementary insurance means at least the employer’s share of the premiums for General Old Age Insurance, General Widows and Orphans Insurance, General Insurance for Special Medical Expenses, Accident Insurance, Health Insurance and Pension Insurance.
  3. In the event of an employment contract of a smaller size than the usual full-time employment contract of the responsible person, the parties will not agree on any income that per calendar year exceeds the maximum remuneration referred to in Article 3, multiplied by the number of hours to which the employment relates. and divided by the number of hours of full-time employment.
  4. In the event of an employment contract of shorter than one calendar year, the parties will not agree on a remuneration that exceeds the maximum remuneration referred to in Article 3, multiplied by the number of days to which the employment relates and divided by 365.

Article 3

  1. At a (semi) public sector entity, the highest annual remuneration does not exceed NAf 474,236.76 gross. This remuneration includes: a. Remuneration;
    b. the holiday allowance;
    c. the holidays;
    d. monthly fees;
    e. accrual of pension rights;
    f. allowances and allowances; and
    g. any other remuneration or benefit, in cash or in kind, under whatever name.
  2. The employer’s contributions, as referred to in Article 2, second paragraph, are not counted as income.

Draft national decree, containing general measures, for the implementation of article 56, fourth paragraph, of the National Ordinance on the Supervision of Stockbrokers and Asset
Managers (National Decree on application and registration costs for stock brokers and asset managers) (case number 2019/051625)

Advice: With reference to your request for advice dated November 27, 2020 for the opinion of the Advisory Council on the above subject and in connection with its handling on February 1, 2021, the Council will inform you as follows.

Examination of the present draft and the accompanying explanatory memorandum, as well as the other documents enclosed with the request for advice, does not give the Board any reason to comment.

Nevertheless, the Board points to the second paragraph of Article 3 in conjunction with the second paragraph of Article 8 of the Central Bank Statute, which stipulates that the countries of Curaçao and Sint Maarten will ensure that their national legislation is of the Central Bank of Curaçao and Sint Maarten, and the implementing provisions based thereon, are uniform and compatible with the Central Bank Statute, as well as contain an identical commencement date. It cannot be concluded from the documents enclosed with the request for advice whether consultations were held with Sint Maarten about the proposed design in the present draft. The government is recommended to take the aforementioned articles into account.

For technical and editorial comments, the Board refers to the appendix accompanying this advisory report, which forms an integral part thereof.

The Council suggests that you decide accordingly.

The Council points out that Article 27, paragraph 7, in conjunction with paragraph 6, under b, of the National Ordinance Council of Advice prescribes that this advice cannot be disclosed.

Both the design and the explanatory memorandum have legal and editorial imperfections. The Council cites the following examples.

The design

Article 2

It is proposed to include the article “the” in parts a, b and c of the second paragraph between “for” and “application”.

It is also proposed in the third paragraph to replace ‘This amount will not be’ by ‘The amount referred to in the second paragraph will not be’.

The explanatory memorandum

It is proposed to:

to indicate in a footnote the location of the national ordinance referred to in the first sentence of paragraph I. “General part”;

to indicate in the first sentence of the fourth block of text of paragraph I. “General part” what the consultation date or consultation period was;

to include in the last sentence of the last text block between “one” and “of” the word “been”, on the understanding that the latter word will be deleted from the first sentence on page 4 of the explanatory memorandum.

It follows from the third block of text of paragraph I. “General part” of the explanatory memorandum (page 3) that in order to determine a method that will be used in the calculation of the costs for an application or registration, a link has been sought with the region. . Later in the same paragraph, but in the third block of text on page 4 of the explanatory memorandum, it follows that the Central Bank of Curaçao and Sint Maarten has aligned its rate determination process with the application rates used at competing jurisdictions in Europe and in the region.

The Council advises the government to correct this discrepancy in the explanatory memorandum by adjusting the explanatory memorandum.

Sint Maarten, one of the four constituent countries of the Kingdom of the Netherlands, is a small, high-income island state. On September 6, 2017, Sint Maarten was severely affected by Hurricane Irma. In April 2018, the Sint Maarten Reconstruction, Recovery, and Resilience Trust Fund (SXM TF) was established at the World Bank. The SXM TF’s strategic framework sets out the project’s support for: (1) post hurricane recovery and reconstruction of Sint Maarten; and (2) longer-term development priorities to strengthen the country’s resilience. This report provides an overview of activities executed under the SXM TF from January 1 to December 31, 2020.

Police seeks public’s assistance with several armed robberies cases

Several armed robberies around Philipsburg over the weekend have the attention of police officers of the Specials Unit Robberies (SUR). The public’s assistance is sought to help law enforcement to apprehend the armed robbers. Anyone with information about the robberies, or who may have seen or know the suspects are urged to contact the Police.

On Saturday, March 20, 2021, around 4:00pm, two men dressed in dark clothing and brandishing firearms entered and robbed a Front Street jewelry store at gunpoint. They bagged jewelry and fled on two scooters that were spotted by A police patrol. The suspects were chased by officers to the Oyster Pond border, but they escaped to the French Side.

The second armed robbery was in the evening. Police Central Dispatch received a call on around 9:00pm about an individual who was robbed of his gold chains in the Festival Village. According to the victim, four (4) young men dressed in dark clothing and brandishing firearms robbed him of his jewelry next to the Festival Village restrooms. The robbers afterward fled the scene on foot.

The third armed robbery occurred on Sunday, March 21, at approximately 4:00pm in the parking lot of a supermarket on Juancho Yrausquin Boulevard. Three (3) tourists were threatened with a firearm and one of the group was robbed of his jewelry. The preliminary investigation shows that three victims got out of their car and were suddenly approached by two armed young men from a nearby car. After threatening and robbing the victims, the two suspects fled the scene in their car.

KPSM: Man arrested for sexual assault, St Maarten

The Police’s Department of Juvenile and Morals arrested a suspect with initial R.C.R. on Monday, March 15, 2021, in connection with the sexual assault of a minor.
The assault took place when the victim was 12-years-old and living in Curacao. The case is under investigation by the Curacao Police Department.
KPSM learned that the suspect had recently traveled to Sint Maarten and with the consent of the Prosecutor’s Office OM SXM, the suspect was arrested on March 15. The suspect was questioned and is incarcerated pending further investigation in the ongoing case.

The Police Force of Sint Maarten (KPSM) conducted a review of traffic accidents that took place on the island of Sint Maarten in the month of February. In total there were about 124 road accidents registered with the Sint Maarten Police Force between February 1 and the 28 2021, the police said on Monday in its traffic accident report.

The most of these vehicle accidents happened between the hours of 12.00 pm and 01:00 pm at different locations on the island.

One common trend observed in the month of February was serious injuries sustained by individuals riding on Scooters. Most of the accidents involving the scooter have to do with the ongoing epidemic of risky behavior being shown by some of the riders.

Riders have become more brazen and callous with their behavior on the public road. Some individuals seem to be getting a kick out of driving reckless between other vehicles, videotaping, and posting it on their Social Media pages.

The KPSM makes it known that this behavior is not boding well with us or the general public. Police are not going to tolerate this level of behavior on the road. If the scooter riders intend to run the gauntlet, then they will suffer the consequences when caught.

Again, it was revealed that the human factor appears to be the most prevalent contributing factor of road traffic crashes. This includes both driving behaviors such as reckless driving and violating the traffic law of Sint Maarten.

Reckless Driving

Speeding, changing lanes without looking, hopping off scooters and motorbikes, and ignoring road signs are all classic signs of reckless driving. Illegal driving habits are one of the most common cause of road accidents on our island.

Reckless driving usually involves a motorist that is less concerned about other road users than they are. Abide by the traffic rules, it may save your life.

Prosecutor’s Office keeps focus on relational violence awareness

The Prosecutor’s Office OM SXM held two relational violence (domestic violence) workshops with the Police Force of Sint Maarten KPSM on March 18 and 19, 2021, at the Philipsburg Police Station. The workshops were a continuation of the series that started in November 2020, with the goal of creating more awareness, education, and guidelines for dealing with relational violence cases by the police.

Handling relational violence cases and keeping the focus on this topic continue to be high priority at KPSM and OM SXM. In 2020, the charge of relational violence was levied in 61 cases by OM SXM. That number is worrisome and continues to be so for both organizations.

Therefore, these workshops, crucial in tackling relational violence, targeted various departments within KPSM including its management, police-in-training, and dispatch officers. OM SXM and KPSM representatives who handle relational violence cases were joined for the workshops by Cassandra Richardson, a gender-based violence awareness trainer, and Vanessa Fraser, Director Safe Haven Foundation, which operates the shelter for battered women and children.

OM SXM representatives explained to workshop attendees how domestic cases are handled when it comes to prosecution and what is needed from the police in such cases. Ms. Richardson had an interactive presentation about gender-based biases and gender-based violence. Ms. Fraser outlined the services Safe Haven provides for victims of relational violence.

OM SXM uses the term “relational violence” opposed to “domestic violence”, because this type of violence is not limited to violence among people living in the same household. It can include partners and ex-partners, immediate family members, other relatives and family friends. Relational violence or assault can include physical and sexual violence, stalking, and threats.

Victims of these cases are often women and children.

DUTCH SINT MAARTEN AND FRENCH SAINT MARTIN GOVERNMENTS MEET TO DISCUSS TAX COOPERATION

** DUTCH AND FRENCH GOVERNMENTS MEET TO DISCUSS TAX COOPERATION **

Possibility of tax harmonization between both sides.

Minister of Finance, Ardwell Irion and President of the Overseas Collectivity of St. Martin, Daniel Gibbs, together with their delegation, met on Friday March 19th to discuss how both sides of the island could achieve tax cooperation. With the support of the department of Foreign Affairs, both parties expressed the desire for research into areas of possible tax harmonization, highlighted gaps in the systems and presented possible solutions.

During the meeting, there were discussions about a system where both governments can have access to certain data that would be beneficial to both parties and improve on leakage. Topics such as turn over tax, transactional tax, income tax and sin tax were discussed. A follow-up meeting will be organized in quarter two.

The reality of two countries sharing one island with an open border brings with it complexities as it relates to taxes. These discussions are therefore crucial and necessary as we continue the tax reform process. The goal with the tax reform is to simplify the process, minimize tax evasion and increase revenue.
